Got taken out by a car pulling into my lane!
3 lane road
Lights at the end of the road, left lane turns left, other two lanes turn right.

I was in the clear right lane , middle lane there was a lady in a car which i was about 2 cars length away from.
She sticks on her indicators, i keep my distance expecting her to pull into my lane, i wait 10 seconds and she still doesn't pull into my lane, i think maybe she left her indicators on. I speed up a bit to make my way to the lights and as soon as i come upto her she pulls into my lane going into the side of me and knocking me off the road.
Spend 4hrs in hospital, luckily nothing broken just badly bruised and sprained, wont be walking for a week.
Bike came off allright too, broken levers, scratches and my the metal parts that hold my indicators on bent.
Police came and took a witness statement.

Am i in the right? she did pull into my lane without checking her blindspot.
Can anyone advise me what to do now? call my insurance company?

and should i exadurate the damage and say all those scratches wern't there before? ohh and that rust must have formed from the impact too!

As above, although she really should have checked her blind spot. Try if possible to record any calls between you and anyone official or involved form now, and photocopy any correspondence incase.

what so i was supposed to stop and wait till she finally decides to cross lanes.
I didn't go into the back of her, she went into me.

If you were in a two lane street next to a car that was indicating into your lane and there was traffic infront and behind you so you cant move, how is it 50% your responsibility if the car on your left pulls into you taking you out

I have a claim in at the moment where someone drove out of a petrol station and into the side of me. Insurance are asking if I'll accept 25% of the blame since I was not able to brake quick enough to stop the accident Rolling Eyes

Highway code does say something about simply using your indicators doesn't give right of way

make contact with your insurance company asap, they will give you the best advice. Don't agree to anything until you have spoken to your insurance.

Tricky one.

As you were behind her and saw her indicator come on you should really have allowed her time to complete her manouvre before you came alongside her. But doing so would have been more courtesy than law!

However she should definitely have checked her mirrors & blindspot before she made the manouvre as well - so many people in cars think that if they don't see a car there is nothing there...... Sad

No independent witnesses? 50/50 and glad you're not too badly hurt. Thumbs Up

You should have her details, personally I would call her before you call your insurance company and see if she is willing to just leave it. It will cost you more in the long term because of raised premiums etc. if you go through insurance.

All that proves is that the light works.

Indicating is to show your intentions it does not give you right of way like a lot of the tossers I encounter on the motorways think.

No, but it does give you warning that the vehicle may be about to move or the driver might be about to do something stupid, allowing you to hang back or blat past hopefully without incident....... Confused

the police took a witness statement in my favour.
If i were to claim i would say the damages would come under 100.00

To be fair mate, if she was indicating, you coulda waited til she had completed said maneouver, and if she didnt complete the maneouver, could have just hung back for a while until you are certain they have just left it on or whatever.

never trust them ever ever ever ,

me instructor years ago (who incidentally is no longer with us) , said it just proves the bulb works,

my Hyundai Santa fe incident had an indicator going the other way,


EDIT:

MSM - mirror signal Manouveur, missed the mirror bit , I think you have a fairly good chance , unless the lane you were in is a dedicated lane for that turning.

there were no road markings to indicate that. and your definately not supposed to pull into that alleyway from the middle lane.
I gave her a ridiculous ammount of space and time to make her lane switch.
after she refused to swap lanes even though she had the whole road to herself i thought it might be some old bat who left her indicators on, or she was pointlessly indicating that she wanted to turn right at the lights

talked to my insurance..that was the biggest piss take ever what do i pay them for.
After ringing 4 more numbers apparently she isn't claiming liability and im waiting for them to ring me back to arrange a vehicle inspection.

6 months after my accident the 3rd parties insurers still havent accepted liability even though the driver who hit me was drunk and got banged up because of it.

Hope you get it sorted out quickly.

I would say it wasnt your fault from what you said, but insurance companies are sneaky swines and will try to weedle their way out of anything.


I think it was Colin who wrote a good post on what to record after an accident, as you will forget, basically write down as many details as you can remember. As in a few weeks you wont remember as well.
I`ll have a look for the post and link if i can find it.

Haha I thought my claim was straight forward, thats rediculious. I've been waiting 3 months after a guy hit me on the roundabout I was going round he pulled out, I didn't even see him till he hit me.
