is it my fault if i got hit whilst filtering ?

i was stuck in a traffic jam when i realised there was a big enough gap in the middle to me to filter throught. so i did.

next thing i know a peugeot 206 pulled out on me just as i was about to pass him. Mad

luckily he only hit the back of my bike missing my leg by a few inches.

no real damage was made to my bike apart from my indicator at the back.

is it my fault for filtering or the driver for pulling out.

when he came out of the car he dint start saying it was my fault or anything, he was very calm quiet and took my details. i dont know wheather he knows its his fault or not Confused

This post is not valid on 1 count:

#1 it does not have a crappy MS paint picture of your crash which is virtually BCF law!

That is the car driver's fault. He clearly didn't use his mirrors before pulling out, so it's his fault.

If you were traveling in the same direction as the car I cannot see how it would not be his fault - as you have passed him, would be in clear view, and as such he has no reason for hitting you.

Undertaking or overtaking?


If over taking, Im thinking you should be fine,

Undertaking, not sure if they'll look faveorably on you.


Moving traffic?

traffic was definatly not moving, thats why i decided to go for the gap in the middle. if im right i was over taking, as i was in the left lane to begin with.

It used to be 50-50 but there was a new judgement fairly recently that changed it in favour of the biker, unsure of the new percentage though.

well i got knocked off mine a few weeks ago whilst filtering. the women admitted to me she didnt look in her mirror so hope it stays that way. just a shame its written the bike off Sad but will really depend on what he says and what lane he was in id say

i have tryed to do a picture but it wont let me up load it.

it was the car on my right who hit me, i manage to stay on the bike and just missed the car on my left, so to be honest i was pretty proud of how i handled the bike Razz

Unfortunately mate, sounds like that will be classed as undertaking, as it cant be overtaking, if you were on a cars left

but its STILL 50/50 cos she should have looked Thumbs Up

"Do not overtake on the left or move to a lane on your left to overtake. In congested conditions, where adjacent lanes of traffic are moving at similar speeds, traffic in left-hand lanes may sometimes be moving faster than traffic to the right. In these conditions you may keep up with the traffic in your lane even if this means passing traffic in the lane to your right. Do not weave in and out of lanes to overtake."

Was the traffic stationary?

As far as I can see you were legaly filtering Thinking ?

he got in touch today and said that he is waiting for his insurer to get back to him, he said he will pay for the damage done to my bike out of his own pocket if worst comes to worst, because he has 4years no claims bonus, so to be honest i would feel bad if he lost like 2 years for something what will cost like £5/10 to repair.

i told him i dont have anything to loose, but its his decision wheather he wants to go 50/50

What's the damage to his car and is he wanting you to pay for some of it?

If he's offering to cough up for the damage to your bike and leave it at that then I'd go for it, much less hassle than dealing with insurers plus obviously there's the NCB issue for him.

he told me he got a mate who works in a garage and asked him to look at it and said that its not a big problem and cheap to fix, would do it for him for free parantly.

all the damage was his left mirror and a small scratch and dent.
but he said that the dent is barely noticeble and the scratch, his mate can sort out, god knows what his doing witht he mirror.

but he already told the insurance about it and they are sorting it out now, so i dont know wheather he will tell them that he will pay for the damage to my bike himself or what, end of the day the worst that can happend to me is for them to settle on 50/50.
