I've recently moved from Grantown on Spey (near Inverness) to Edinburgh where I don't have a garage or anywhere to keep a bike in the winter. My beautiful 98 R1 is being stored at my mother's holiday cottage where my older brother is staying for the time being. He's just been on the phone to tell me that while working on a friend's car they decided to drive in into the garage to work on the brakes. Well it seems that the brakes were completely non existant and his friend drove straight in and pushed my R1 right up the back wall. Damage (to my brother's untrained eye) is broken front fairings, light, mirrors, indicator, tail fairing, bent and dented exhaust and twisted forks!
So it seems that my (almost classic) pride and joy is a write off. I'm totally gutted!
I don't know for sure but I get the impression that the driver is both uninsured and strapped for cash.

Garage at a house?
House insurance?

Have a look and see if it is covered, if it isnt, get it covered, and get creative with the date it happened. Smile


Most house insurances cover garage contents up to a certain value.
You dont lose your no claims, and house insurance wont go up too much, if at all
A few k bike is nothing in value when compared to 100k house that could potentially have been burnt down with possessions. Smile



Bad luck on the bike though. Sad

So where do I stand here? My bike is fully comp insured but the offending driver is uninsured, can I claim?

You can claim on your bike insurance yeah, but you will lose no claims and/or will have to declare a claim which will put costs up for 5 ish years


For house insurance claim dont even mention the car hitting the bike or the lack of insurance
take the fairings off, and say they were laid on the floor as you were working on the bike, car didnt see them and drove over/into them causing the damage caused
Claim is for the fairings, not the bike, so it wont be a write off

See if you can claim off his insurance first, tell your brother hes going to have to chuck in if the car owner is uninsured then get him done by the police for driving without insurance.
After what happend to dodger i'm even more reluctant to claim off my insurance as his bike got sent to my works(scrap and salvage car dealer) and sold on as his insurance ruled it as a cat D the lowest form of cat damage.

House insurance almost certainly excludes motor vehicles.

Are you fully comp? If you are, your insurance company will pay out but will certainly chase up the other chap. I don't know if he has to be insured on private not publically acessable land - I suspect not, so they'll chase him personally.

If he's not, you'll have to get him to pay up or use your legal protection cover (most people with 3rd party insurance take it out for just this sort of thing) to do it.

As he hasn't got any money, tell him that it looks like he's going to have to sell that car he was doing up.

He could always insure the car and then crash into it again next week (you don't have to have tax and MOT to be insured).

At the end of the day, you shouldn`t really have to pay for his mistake. I don`t know how friendly you are with him, but it sounds lke alot of work that needs doing. Like previously mentioned, he has a car he`s doing up. The proceeds of that sould cover your damages.

I agree. It might seem harsh, but it's his mistake, he should pay up!

EDIT: Your brother might have said "Minor damage", but chances are he doesn't have the SLIGHTEST clue about bikes. Fairings can cost ALOT, and a dented frame will mean its a write-off if i remember correctly...

Just checked and motor vehicles are not covered by my mother's house insurance.

From what I understand it's a 10year old Xantia he's doing up with no mot/tax etc. I don't know the guy from Adam, he's my brother's mate.

Questionable whether the sale of the car will even cover the cost of repairing the bike then! Considering he`s 'doing it up' and all!

Tbh mate i'd get him and your brother to pay for the repairs or replacement parts, the fact the brakes needed doing and he was going to drive it into the garage makes a stupid combo. What if your bike wasnt there? he could of ended up knocking the garage wall down, its just not a bright thing to do either way. So to teach them to look before they fuckin drive a brakeless car into a garage make them pay.

That's not going to work its a garage on private land. You don't need
insurance when off road.

We once had an abandoned car dumped on our drive, unfortunately the police couldn't touch it as it was on private land.

Its the same for drink driving, you could drive up and your drive as many times as you like pissed as a fart, as long as you don't touch the road, your not breaking any laws.

If you have a none fault accident it still puts your premiums up, am sure we had a thread on this a while back although I may have been told by the wrong source however. Also ask your company if you can keep the bike so what happend to Dodger doesnt happen to you.

He should definitely pay. Even if it means taking him to small claims court or something. I think that you can claim for up to £5000 and it's only say £3000 for a 98 R1 (though anything you added extra to it if you have receipts should be claimed for too). Probably not worth repairing unless some fairings come up on eBay by chance.
