Well, as a few of you know, i was stopped for speeding, the courts decided not to ban me, and gave me 6.
Wich is good as i can continue my job. (with 9 points over my head)

ive just recived a letter from the DVLA saying that "you have recived points" blah, you are revoked 5 days from this date.

i was convicted out of my 2 years, i have a total of 9 points.

what the hell, is this just a DVLA computer cock up?
The courts asked my solicitor if i was currently out of my 2 years, wich i was.

court date was the 10th, letter issued on the 11th.

You weren't when you committed the offence though.

Looks like the DVLA are right.

Unless the courts mentioned it at your hearing I'd ring the DVLA and ask them what's going on.

If the offence was committed before the two years were up, then yes, your licence has been revoked and you need to pass your test again.

The New Drivers Act:

The new drivers act affects drivers that passed their driving test on or after 1st June 1997. If you get 6 or more penalty points on your licence within two years of passing your driving test the DVLA will revoke your driving licence.

To regain your full licence you must:

* Get your provisional licence again.
* Pass the theory and practical test again.

Points counting towards the total of 6 include any you received up to 3 years before your latest penalty point offence. Points imposed after the 2 year period will also count if the offence was committed during that period. Passing the retest does not remove penalty points from your licence, and if your total points reaches 12, you are still liable to be disqualified. (Just like everyone else!).

Hi

Speeding points count from the date of the offence, not conviction. Hence you got points within the 2 year probation period as far as the DVLA are concerned.

The only way the the court could have avoided revoking your licence would be to give you 2 points and have made the total 5.

This was explained to you in the last thread, it was said your solicitor made a cockup, and that because the offence itself was within the 2years you will get a totting up ban, the date of the conviction is irrelevant. The judge was correct, he didn't give you a ban, he gave you 6points, which results in the DVLA revoking your licence.

The same thing happend to me, although this was before the 6 point/ 2 year rule.
I clocked up 12 points for minor offences and had to go to court, I sent a letter saying I needed my licence for my job and also included a letter from my employer saying he would let me go if I was disqualified.
It worked as I got off with the pints and fine but no ban.

out of curiosity, if i do get revoked, does my 2 years start again, also what happens to my no claims?

Insurance has nothing to do with it. Same as using discounts you received on a 125 against a 600.
