Insurance Claim Hire Bike costs - recoverable?

Hi all,

Hoping some of you can give me some advice.

Following my accident in January 2007, I had a hire bike from Carole Nash (my insurers) for about a month until I got my Ninja.

The claim still hasn't been settled beyond CN paying out for my written-off SV (minus excess).

I received a letter from Carole Nash this morning saying that I have to pay £2,400 for the cost of the hire bike within seven days. Needless to say my jaw hit the floor.

Is there anything I can do, or do I just have to swallow hard and pay up, hoping that my claim gets sorted quickly?

Any advice gratefully received.

If the accident was the 3rd party's fault then u can claim from them. If they refuse to pay, go through the insurance to recover all costs.

If it was your fault u will have to pay.

Sorry if i have missed anything, or stated the obvious.

Are you claiming off another party? Do you have a solicitor for your uninsured loss recovery? That's all your gear, compo, excess, recovery fee..........which will include your loan bike hire charge. If you do, then send it to them, and they will add it to your claim against the other party.

As said before, if there's no-one else involved you're footing the bill.

Yes, apologies for not making that clear. I have a firm of solicitors appointed by the insurance company who are chasing the claim. The third party (a German lorry driver) is disputing the claim so it is taking ages to get sorted. If they eventually award in my favour, then I'll hopefully be able to recover the costs. If it's 50-50 then I'm in a grey area I think.

I just wondered if anyone had been through the whole claim thing and knew whether or not I would have to pay the 2400 quid now and hope my claim was settled quickly, or if they'd be prepared to defer the request for the money until after the claim was settled. I'm guessing I already know the answer, I suppose.

If they are after the cash, can you not inform them to contact your solicitors of the 3rd party regarding this.

If itis undisputed that liability is the responsibility of the other driver, then providing your solicitors are on the ball, they can pay that bill as what is called a disbursment on your behalf and then claim it back whenthe case settles.

However, if liability is disputed, your solicitors may be reluctant to pay this cost as they will then have to invoice you, or take it out of any compensation you are awarded.

You need to speak to your solicitor as a matter of urgency and get them to confirm their position on the matter, they may well have an arrangement with your insurers as their panel solicitors for these very type of problems that crop up.
