 Posted: 11:58 - 08 Mar 2008 Post subject: The treaty, simplified. |
 |
|
For your information.
Some politicians and legal bods have combed through the Lisbon Treaty/EU Constitution and produced a synopsis of the document. I will greatly simplify it and post some important points for those who are not yet familiar with it. (edited)
The treaty creates a Union Parliament for you, the Union's new citizens.
It will change your MEP's into "representatives of the peoples of the Member States". Whilst this appears to be a minor shift, it illustrates the constitutional shift the Treaty makes from the present European Union of national States and peoples to the new Federal Union of European citizens and their national states . First and foremost you will be a European
Does this indicate the 'end of the line' for MP's? (unless they're MEP's)
Presently, you are notional or honorary citizens of the European Union. So being a citizen of the EU is perhaps an idea which you can reject if you wish. However, this treaty will make you a fully fledged EU citizen. Your EU citizenship will take primacy over your British citizenship. (article 17b.1 TEC/TFU)
The EU assumes the "intergovernmental" powers over foreign policy and crime, justice and home affairs which at present are outside the scope of European law. The European Community disappears and all spheres of public policy will come within the scope of supranational EU law-making either actually or potentially, as in any constitutionally unified State. The name European Union will stay the same in order to hide the enormity of the change.
The European Council will become the Cabinet Government of the new Federal EU, and its individual members will be primarily obliged to represent the Union to their Member States rather than their Member States to the Union, which is what happens at present.
You will have a new Union political President who will represent you when visiting other states/countries. The President of the EU must not be a Prime Minister or leader of any member state. ie Gordon Brown.
Your national parliament will be subordinate to the EU. Article 8c TEU states "National Parliaments shall contribute actively to the good functioning of the Union". The imperative "shall" implies an obligation on National Parliaments to further the interests of the new Union. How long our national parliament will be allowed to operate is another question.
The Union gives itself self-empowerment powers. In other words, if the Treaty does not provide the Union with enough powers, the council can take appropriate measures to assume more powers by unanimity. If they cannot get enough votes to introduce new powers, they can switch to a system of qualified majority voting. In other words, they can make more powers for themselves as long as everyone votes in favour. But if someone doesn't vote in favour, they can say "screw you Jacques, we can switch to majority voting and ignore you. We'll have our powers whether you like it or not" |

Yes yes I know that its that treaty they did in Ireland ie vote the right way or we will hold it again and again etc etc , thus whatever gets us the deepest trough gets the nod of their parliment.
You know I just thought of something , the day the treaty is rattified Thatcher will be suddenly rushed to Hospital , with wall to wall coverage on all TV channels many people will be distracted and not notice it going through. ____________________ Spain 2008France 2007Big one 2009 We all die. The lack of posters in a topic of this importance astounds me.
Are people genuinely disinterested or do they believe we are past the point of no return?

Its pretty low down on voters cares according to a few websites, the main issue was on the EU treaty was not to treaty itself but the deceit being talked to like children and the lies that it wasn't the same and clear reneging on promises. ____________________ Spain 2008France 2007Big one 2009 We all die. I read it, But didn't really understand it. Citizenship at school was a farce, and its only now I'm talking to people of all ages and jobs and wealth through my work that I'm starting to think outside the bubble I'm in just after leaving education.
So basically I'm no longer british/english, I'm now a european, and I have no say in this, and my MP is no longer my MP because he has to be european elected?
