Dear all,
I am emailing for advice on what to do about a car that hit me on Friday and drove off. I was cycling along a main road in the cycle lane, and was going across a T-junction. The markings for the cycle lane stop in front of the T-junction, but there are no markings to suggest that I should stop myself. A car from behind me was turning left, and cut directly across my path. It almost hit me head on, so I started to slow down, and then the back of the car hit me as it turned round the corner. I fell off the bike into the road, and the car drove off. I suffered whiplash and bruises, but I was not aware of this until much later in the day, and I got up and chased the car on my bike. The driver turned a corner and parked in front of her house. When I told her she had hit me she asked me where it had happened, and then said I should use my eyes and that it was her right of way. When I argued and told her it was not her right of way, and she should stop anyway, she said she didn't care, if I didn't want to get hit I should be more observant, and to fuck off and call the police. I did call the police, and went to the station and gave a statement, but as I did not seem injured at the time they were not very interested.

Nevertheless, they said they would visit her that day, and call me with her details so that, if I needed to, I could claim on her insurance. I have called every day since then, and today they told me to call back in two weeks. I am worried that nothing is going to be done. I also failed to go to the doctor to get my injuries checked, and the pain is now subsiding. Should I still go to the doctor? And what can I do to ensure that this driver is punished?

Seriously though I don't think there is anything you can do if you weren't in enough pain to see a doctor. Sounds very much like a "Where there is blame there is a claim" attitude to me.

Either you've been really injured and there is a claim to answer, or you're OK and your bike is OK in which case you can chalk it up to experience.

Or you could wreak horrible vengeance on the woman in question of course... which is what some people on this forum might suggest!! Smile

Definitely go to the doctors, do it ASAP. Also take a note of any damage to the bike, take photos.

I know its not a motorbike, but the principle of it coupled with the woman's 'I don't care attitude' bothers me immensely.

Not sure on the process, a doctors report handed into the police station maybe? Causing injury by dangerous driving? If the police do nothing, I'd be getting seriously inventive at making her life crappy for the foreseeable future.

Although on a pushbike i think that it would be handy for other motorcycle riders or road users to maybe know what can be done if knocked off by a hit and run driver too so theres no need to be so hostile.

Unfortunately in the OP's case i don't believe there'll be much done as its basically your word against hers unless there was other witnesses. If there was damage to both vehicles then yeah the police may be able to match the damage up but as it stands theres not enough evidence.

I can be the vindictive type so... you know where they live and you know which car it is.... get creative...

Maybe the OP's grammar is not so good. Having asked for some advice and for those who wants to give advice that if its a windup I don't see what the desired reaction would be...

I was in an accident a while ago and at the time i thought i was uninjured. The lady who caused the accident did kindly take me to the hospital after the accident, but i had no pain or anything so thought it was a waste of time.

About a month later or maybe longer, I had pain in my shoulder for about a month. For a week or so it was quite extreme.

I went back to the hospital again and this time got an x ray taken as a precaution knowing small fractures can sometimes go un-noticed.

I was putting a claim in anyway on her insurance as she had written off my bike. My insurance company appointed solicitors to deal with it, and they had me go to see their specialist to descibe the pain I had had. It took a year for me to get a payout for the damage to the bike, and Im due to get £1000 for the pain i was in a while after the accident. I didnt exaggerate my sypmtoms, and the doc classified my pain as low level as although the hospital had suggested i take a pain killer, i didnt want to, as it wd stop me give the arm enough rest, and stop me knowing when it had healed.

People can get mild whiplash when they have been in a car and have a mild bump. Lots of people put in claims I dont know if they are genuine or not, but if you have been knocked off a bike, I think theres a good chance any whiplash type thing could be more serious.

I think its worth contacting a personal injury lawyer. So what if people think you are part of the claim culture. You got hurt, it was her fault, maybe if you make a claim against her, her premiums will go up, and it will make up for you being pissed off about her injuring you.

Putting bricks through windows or whatever could get you in trouble so isnt worth the hassle.

I dont know if you have got a good case, but a personal injury lawyer would have a better idea.

I wouldnt always make a claim. A few years someone went into the back of me when i was on my bicycle. He mangles the back wheel, and i was knocked off resulting in a deep graze to my hand and blood dripping out at a fair rate. It wasnt my fault, but it wasnt entirely the guys fault, as he had had to avoid someone else who had pulled out, and unfortunately hit me.

He was worried i would make an injury claim when he saw my bloody hand, but i just wanted the money for the wheel, which he sent me.

If you think the woman was at fault and her attitude stank, I think you should make a claim as it might encourage her to be more careful in future.l

Too many women pull out expecting other people to stop for them when its not their right of way. I know some people may think its wrong for me to say that, but its what i've noticed to be true.

I doubt the police will be arsed to do anything unless you got witnesses, but a lawyer might. With the attitude she has she may well be quite happy to admit what happened, not even accepting she was in the wrong. Thats what happened with me. Although I had taken witness details, they were just kids and their stories contradicted each other and were unclear.
Whereas the woman who wrote off my bike freely admitted that she hadnt checked her mirror before turning right, while i was overtaking.

I had thought it would be 50 50 but it was 100% in my favour.

In your case, I think you were even more in the right as she cut you up. In my case someone could have argued that i shouldnt be overtaking near a junction, which i think wd be a good point.

She might not realise she was at fault even if you do get a pay out, but I dont think you should let her get away with it. If anything cyclists are more vulnerable than motorcyclists. The fact she didnt even know she had hit you, shows she really wasnt aware of what was around her.

If its you this month, it could be someone else next month. If a few start kicking up a fuss, she might start to realise she should be more careful.

Today, had a woman try to undertake me as I rode off from a set of lights that changed green. At the lights I was in the middle of the lane and she squeezed in on the left in the gap, so naturally I assume she is going to turn left. But no, next thing I know as I pull out she's by my side and the road is getting narrower and there's a car behind me so I didn't want to slow down. I accelerated and heard her shout some abusive language at me as she had to slow down and drop behind. I *think* she was in the wrong. I (hardly ever giving in to road rage, with this being an exception), gave her a single finger salute. Middle Finger

I ride a push bike as well and have had a few near misses, mainly at junctions where the driver doesn't see me and pulls out in my path or into me! And I'm in high-vis... My boss had a woman undertake him when he was on his push bike and she buggered his front wheel. She was apparently messing with lipstick or something and there was a police car near by that stopped her. She made a comment along the lines of "I can't be doing with this hassle today.", to which my boss replied "I can't be doing with getting killed today!". It also transpired that she should have been wearing her glasses but wasn't...

The amount of women I see at traffic lights fiddling with make-up or other stuff really scares me. Neutral
