https://news.bbc.co.uk/1/hi/business/7364422.stm

So they have until the 22nd of May to appeal, and if they don't then that means people can claim back overdraft charges.

Now this is interesting for me because I owe the Abbey National £250 of overdraft charges. I paid back the money I owed them outright, but when the charges came in I decided to stop using the account, so they mounted up (interest, further overdraft charges for going overdrawn when the first charges came in, etc).

Obviously this will mean that I no longer owe them this money, but quite a while back I run up another set of charges (about £100) which I actually did pay. What are my chances of claiming this back as well? Considering that I've been in debt to them for so long over the second set of charges that is.

*is looking forward to being debt-free and £100 better off...*

Looks like you and many others have to play the waiting game.

My work colleague is looking to claim back roughly £7000 in bank charges.

You need to register your claim with them. Or once again you will be getting charged if you go over your limit.

Don't think this is going to be settled this year, pretty sure that the banks will appeal, as the judge did back their side of the case to a point.

Remember this is not about stopping charges only the OFT thinking the amount charged is unfair.

So you will still owe something.....

I'm reasonably convinced "free banking" is something of a myth anyway...

Rest assured the banks will find a way to claw back the money through other means.

At the end of the day it's gonna hit all of the people who actually manage to stay within their overdraft limits.

You read it wrong the banks haven't lost yet the ruling only says that the OFT can actually make a ruling on this thus the actual test case hasn't actually occured yet.

Did anybody say Moral hazard?

you seriously don't want a banking system like HK , where ATMs do everything , you get charged for using cheques , paying money in , not having at least 10,000 in credit in your account at all times AND to boot you get 0.001% interest, with "HIGH" interest accounts paying 0.002%.

If the 'customer' wins this case, does that mean any charges can be claimed back from the opening of your accounts ?

Not exactly the best time for the banks to start losing money, and having to claw it back from customers ...

6 years max.

Which is kinda interesting as these charges have only been considered excessive in the last couple of years, so considering inflation over the last few years and the fact that my charges have been the same since i opened the account 10 years ago, they are more reasonable now than ever.

Hey Ho even the oft cant make its mind up.

One important development, that may come before then, will be when the OFT finally publishes its opinion on whether or not bank overdraft charges are excessive and unfair.

Anyone hoping for a quick payour forget it, bet the london olympics are over and done with 1st.. Laughing
