my 17 year old son saved & paid up front for his motorcycle insurance £380. unfortunately he has been laid off work and has decided to sell his bike have a refund on the insurance and concentrate on further education. he cancelled the insurance in writing and sent his certificate back as requested. They have now written to him telling him that there is an outstanding claim wich turns out to be an old guy who pulled out in front of him but both parties just agreed to forget it as no damage was done to either vehicle. untill this is sorted my son asked the insurance company to just continue with insurance as he still had 9 months left (paid up front) they have said no sorry we can not reinstate your insurance as you cancelled it in writing and no we will not give you a refund as there is a claim being investigated. i am fuming has anybody seen anything like this before if so any advice greatly appreciated.

So I take it the old boy went to the insurance?

Did your son not know of this before now?

He was not aware of him informing his insurance company. the guy was about 70 i can only think that his wife or a member of his family advised him to contact them to be safe. they did swop details but as there was no damage done they agreed to just forget it. Anyway my main gripe is that untill it is sorted and that it was paid up front, he asked them in that case continue with the insurance at least he may as well earn a years no claim bonus. but they refuse to do either. sorry to rant on but i am livid, i have just spent half an hour on the phone to them myself, it was like banging your head against a brick wall. The only consolation is i paid for it on my credit card so i will ask visa to look into it.

I would not expect Visa to be any help. You would oly get the money back if it was fraudulent or miss-sold. I would expect the insurance have covered themselves in the T&C's.

I would suggest you write to the chief executive of the insurance company and complain. Also mention that you would like the details of the FSA and Insurance Ombudsmen - this will kick off their official complaints process of which there are strict rules to be followed.

Demand they contact the 3rd party, establish that no claim is being made and request they close the claim off and refund the monies due.

Not a hope in hell of getting anything back there i afraid..... No visa regulation to cover that situation and even if it went via a CCA claim there has been no breech of contract.
You can try, but i'm certain its a non starter....... They may request all the info to look at it.

I think even going higher up will not get anything done as it was cancelled in writing as per their T/C and the certificate returned.
All you can really do is get your lad to ask for detail of the claim and take it from there. Under the DPA they should only talk to him and not you.
