Bought a nokia n95 from ebay, described as 'New unused'
When i got it, it works perfectly, but was obviously not new (Hours on call timer, texts in drafts folder, other signs to show it wasnt new)
I paid £260 +12 postage
I filed a 'goods not as described' with paypal, who decided in my favour.
However
This is the email from paypal

So I have to send back a phone that cost £262. and due to the protection, only be guaranteed £150 back from them, if they can not recover anything back from seller.
As I said, phone fully works.
Would you send back the phone out of principle, and risk losing over £100 in the transaction (also seller would keep the £262 if he has cleared account, and also have the phone back)
Or just cut your losses, (prob about £30-40 difference between a new and used) and just take it as a lesson learnt, and never buy anything worth more than £150 from ebay again. |

tbh if it all works, i would just keep it, i mean is there really any point in losing money, especially through paypal.

Phoning people is often a good way to sort things out when eBay emails are being ignored, but given you've left feedback you'd be a mug to now send the phone back and expect him to give you your money back.
You could try calling him and see if he'll agree to refund you if you withdraw the feedback (don't even know if there's a way to mutually withdraw feedback now that they've screwed up the feedback system ) but even then I wouldn't be too confident about sending the phone back on the promise that he'll refund you.
Nice example of how eBay's new feedback system is a load of bollocks, as you'd probably have thought more about how to resolve the problem before leaving feedback if he'd be able to leave retaliatory negative feedback.
I reckon now might be a good time to cut your losses and just leave it. |

file a claim with paypal that you never received it. they will refund all money within a week. that should piss him off and teach him for not selling items as described. ____________________ Current : '08 Yamaha FZ1s

Fraud is such an ugly word.
If you tried that one with me two days after your refund you would have court documents on your door mat,

He could always send the item back afterwards.
The fact that he has sold the item, described as new even though its not is also fraud if im not mistaken - With fraud meaning a deception made for personal gain.

Hard to say he hasnt recieved it when he has already complained that they don't match the description
