Yet they can't say on exactly what grounds they have been arrested.

I think the issue here was they were making money out of the site by charging people to join. "Members paid donations via debit or credit cards, ensuring their continued access to the site." That must mean they were into big money as it was a " Interpol-coordinated investigation"......
Start making money and you are into serious issues.

Its the uploading thats the crime, not downloading. One reason newsgroups are so good, as you don't have to share what you have to get good sources.
