The family were then detained under the Terrorism Act and surrounded by "at least 10 police officers" who ordered them to get out of their car.

Ms Maynard was separated from her husband and son, who is autistic and has cerebral palsy, and taken to a detention room for questioning, leaving Joshua distressed.

Ms Maynard said the woman officer told her: "It's obvious he [Joshua] has nothing to do with you".

She said officers had told the family they had powers to hold them for up to nine hours under Section 7 of the Terrorism Act, but they were released after more than two hours.

The terrorism act seems to simply be a catch all solution for when someone doesn't appear to have commit any other crime.

They were quite specifically told they were suspected of trafficking the child. Not very tactful, I grant you - but considering both parents were white and the child was not, it's hardly surprising that suspicions were aroused.

The Eurotunnel is infamous for being a soft touch when it comes to trafficking and immigration offences, so I'm glad to see that someone is keeping an eye on it. Child trafficking into/through the UK is a massive problem that all law enforcement agencies have been warned to be alert for.

The use of the terrorism act to detain the couple because it gives wider/easier to use powers than PACE is a seperate issue, as is the apparent rudeness of the female detective. That said, the complainant is a female lawyer - in my experience they do everything they can to antagonise the police wherever possible.

Does that mean Madonna will be stopped every time she travels?

Or Brad and Angelina?

No?......... Thought not.

My missus is Ginger but my daughter isn't, does that mean she will get stopped?

The child was mixed race. Considering the amount of unwed mothers and fathers and the amount of couples with children from a previous relationship as well as black children being the least likely to be re-homed with black foster parents this happens all the time.

Maybe so but thats no reason to be rude.

Yes I agree. The creep in the use of this law is ridiculous but I'm willing to lay money that if/when you complete your training you use it at least once for its convenience.

Well to be perfectly blunt it is their job. They are there to help the client NOT the police.

Oh come off it, the police have done more than enough to make themselves look bad here; a few more digs from the lawyer are neither here nor there. They were held for two plus hours under terrorism legislation for having a black kid. There's so much wrong with that, where do you begin? A degree of suspicion is understandable but the matter could have been resolved by politely asking to see the passport and then letting them be on their way.

Hi

Frankly, misuse of the terrorism act like this should result in a serious charge. It is an act to be used in extreme circumstances. Misuse like this should be punished severely (say, about the same penalty as making hoax bomb threats).

All the best

Keith

It being an isolated incident is no excuse whatsoever.

The force added that the officer in question no longer works at the Channel crossing and was in another post but the move was not connected to the incident.

It bloody well should be and out the door.

Thumbs Up

Her reactions/comments at the time would play a large part in shaping the plod's actions towards her and her family - whether those actions be right or wrong.

The news story says that 'there were three people on the passport' which suggests to me that the child was traveling on the Mum's passport - thus the officers might only have had a name to go on with, not a picture - a classic child trafficking/facilitating trick.

"Is that your child, that is of a totally different ethnic extraction to you and your husband?"
"Yes it is, look, there's the name written there, with no picture for you to check, so it could be a totally different person!"
"Oh, ok then, no problem!"

Not really kosher, is it?

Sounds like the copper's attitude was out of order (as evidenced by an near-apology from her boss) and I've already stated my concerns re. the overuse of the Prevention of Terrorism act, but as usual to BCF there is a lot more going on than people seem to credit.
