Afternoon all, a few weeks ago I was knocked off my new (to me) Aprilia RSV-R. It was absolutely mint and now it's been written off due to a dint in the frame caused by the rear brake leaver.

I have been asked to write up a description of what happened, and rather than type it out in here I have attached the document to this post. If you could be so kind as to give it a quick read and let me know if it makes sense and if there is anything I should change it in I would be eternally grateful.

Thanks Thumbs Up Karma

I'll post pictures of the bike and my injuries when I get home

Edit: To those without Winzip, link to the file here: https://www.4shared.com/file/63218609/6e30f52d/Accident2.html

Sorted now. I checked to see that .doc's were ok to post, but missed the bit that said they must be less than 1MB. Zipped it now so it's OK (Zip files can be <16MB Confused)

don't expect you'll only fill the one doc out.
i'm currently on my third from when my new blade got hit while sitting in a queue of traffic at a roundabout by a braindead halfwit in a van on the 1st of sept.
he's admitted full liablility(he didn't have much choice by the amount of witnesses that seen it).
shunted me into the car infront and he got wacked by the car behind.
i must admit i was quite amazed at how little obvious damage there was to the bike considering the dent in the van and the bumper being entangled in my back wheel.
took it back to the dealer i bought it from in july and they've given it the once over.
1400 odd to put back to new.
i reckon the front of his van will cost more than that.

Doesn't really need to be that long... get rid of the 'to clarify' bit, it implies the last bit wasn't clear. Ditch anything that says "I moved along hoping he would see me" because that implies you could have taken avoiding action. Also don't make any assumptions about what Mr X is doing. 'Unfortunately he didn't see me' You don't know that - stick to the facts. He could have seen you and pulled out anyway.

Photos are good, the diagram of you lying by your bike is not necessary...

Quote:
Incident Date: 22nd August 2008
Incident Time: Approx. 5pm
Location: Crossroads Junction on Burncross road with Bracken Hill and Hollow Gate, Sheffield.

I had come down Bracken Hill from Sheffield intending to turn right onto Burncross road to head down into Chapeltown. Mr ###### was waiting at the opposite give way junction at the top of Hollow Gate, pointing his vehicle towards Bracken Hill and not indicating, indicating to me <-- replace with "which I took to mean that"
he was intending to cross the junction and drive straight up Bracken Hill. I was indicating right before I approached the junction. Once the traffic with priority<-- unneccesary on the main road had cleared I checked Mr ###### was not moving, or intending to move<-- you're not a mind reader - take it out and set off slowly from the junction turning right. As I slowly<-- Makes it sound like you protesteth too much... came out of the junction I watched Mr ###### car to make sure he didn’t set off without seeing me and he did not move the car at all while I was coming out of my junction, which was to his right. I kept my eye on Mr ###### as I crossed the white lines on the main road and got onto the left side of Burncross road to make sure he did not pull out, no movement at this point occurred. <-- not sure about this... again you say you have your eye on him as if you're staring at him and not looking anywhere else. Once is OK but too many times looks like you're overdoing it IMO As soon as my front wheel was infront of his vehicle, Mr ###### started to move forward. By this point braking would have just stopped me infront of his car on the main road, so I kept moving in the hope that he would see me and stop, allowing me to continue on my way. Unfortunately he did not see me<-- don't like this at all - its supposition not a fact, and as I was directly infront of his car (whilst on the main road) <-- its obvious you're on the road when he hit the left side of my motorbike<-- motorbike is a bad word - use the word Motorcycle its more correct. Do a find and replace on it. crushing my left foot against the bike. Due to the force that he hit me with, I was pushed off the right side of the bike and slid across the road on my front onto the opposite side of the road, separated from the bike. The bike came to rest facing straight down Burncross road on its right hand side, on the centre line a metre or two further down from where I was hit.

Road conditions were good as it was sunny and dry. The road surface was not slippery in any way (gravel, oil spillage etc.) Don't mention the negatives, accentuate the positive otherwise all the sleepy reader at the insurance company will see is 'gravel, oil' its subliminal but it makes a difference. Just say the road surface was good. Light conditions were excellent.

Google Maps view of Junction:

To clarify<-- it isn't clarification its repitition. Just say "here are a few pictures to help illustrate my account"., I was waiting at the junction of Bracken Hill & Burncross Road wishing to turn right, Mr ###### was waiting at the Junction of Hollow Gate & Burncross Road continuing straight ahead.

I was at this junction here, at the bottom of the picture, wanting to turn right and travel down Burncross Road:

Mr ###### was on the opposite side of the road to me (With the acorn Inn pub on his left) wanting to go straight ahead. This is his junction and view:

Timeline of events:

Myself and the motorbike are pictured at the bottom of the diagram as the thin rectangle. The orange circles are my indicators. Mr ###### is at the Junction at the top of the diagram, depicted as the

We are both at our junctions, myself indicating to turn right, Mr ###### not indicating. Both have stopped.

As the traffic has cleared I check for Mr ###### moving off and see that he is still stationary. I set off slowly watching him to make sure he does not pull out.

I continue on my path, I join the correct side of the main road, still watching Mr ###### to make sure he does not move off. He is still stationary.

As my front wheel gets in front of Mr ######’s car he begins to move, I continue forward on the main road in the hope he sees me and stops<-- this really really makes it look like you could have taken avoiding action. If I stop now and Mr ###### still continues forward I will still be hit.

As I continue on my path Mr ###### does not stop and begins to continue on his path as if I were not there. He hits me when I am straight infront of his car. <-- This is OK, you aren't trying to gain insight into his thought process!! in front is better than infront though.

Due to the force I am pushed off and away from my bike, landing on the opposite side of the road and sliding on my front. The bike lands on its right hand side as it has been pushed over by the car.

Mr ###### had more than likely driven up Hollow gate to get to the junction<-- Yuk city. Just stick to the facts. State there are signs nearby that say blah..., where there are the following signs on the side of the road:

This is the view from lower down Hollow Gate approaching the junction, notice the sign on the left:

My motorbike was bright yellow which can be considered a good visibility colour<-you're not an expert and it is a motorcycle! . I also had my dipped headlight switched which is advised in the Highway Code, Rule 86 to make yourself more conspicuous:
“86. Daylight riding. Make yourself as visible as possible from the side as well as the front and rear [...] Dipped headlights, even in good daylight, may also make you more conspicuous.”

Apart from that its good.

{edit} I don't mean to sound condescending... I'm honestly trying to help you... when I reread what I wrote it sounded a bit like that and I apologise - its not meant that way. {edit}

No worries, I knew you weren't being condescending. I was hoping someone would "tell it how it is" like you did Smile

It shows that I forgive you for stealing my name! Wink Seriously though I'm glad to be of service. It may also be possible for you to buy back your slightly dented bike for not a lot of cash...

It's going through my insurance first then they're claiming off his. My Insurance company have valued it at £3600 with a buy back value of £2100. I set myself a cutoff of £1700, so I'm not going for it as it's got quite a lot of damage to it:

Bent right clip on
No front brake lever
Cracked right "ear" wind defelector (carbon fiber)
All right side fairings are scratched
Left side middle fairing panel is bashed in where the car hit it
The oil tank is behind the left side fairing so that's probably squished
Left side footpeg heelplate is pushed into the swingarm
Exhaust has dinted the swingarm on the right side
Brake lever has dinted the frame.

I was going to reply with essentially the same as marjay, basically take out the repetition and be clear rather than using assumptions,
the images are good but the one with the stickman although funny isnt necessary.
Another point from me is the continued use of "watching what mr ##### was doing" sounds a bit like you were concentrating on mr ##### more than on what you were doing, maybe i was concious of mr ##### throughout my manoeuver. Thumbs Up
Other than that your good to go.
