It's 16 months since my off where I super man'd down the road. I still do not know what happened but I had to pay to repair the crash barrier all £4000 worth of it (my insurance).

Then about 2 months ago I got a letter saying it was not my fault and that the 2 years no claims that I had lost where reinstated and a cheque for £120 for over paying on my insurance (which was about 3 weeks till the renewal). My insurance never ended up paying it in the end as I was not to blame they said.

I have just had some fella ring from ULR about it saying that I need to call him. Googling this reveals that he is a solicitor working for Uninsured Loss Recovery company.

Once thing to note about where I crashed it that the week after it was fixed it was ruined again in exactly the same way, then it was fixed then it was damaged. It seems that there is a problem with that corner.
The barrier for all I know could have been in the state it was before I hit it with the metal struts sticking up which is why my arm was so badly damaged, they sliced clean through it.

I would say that in 16 months the barrier has been hit again another 7 or 8 times each time exactly the same spot.

Would you pursue an injury claim? I honestly couldn't tell you what happened all I know what that I was riding along and next minute I am flying through the air. My arm is still damaged now and has permanent nerve and muscle damage.

I was off work for 3 months with my injuries.

Dunno what to do? Should I just let it go and not bother or ring the fella and talk to him?

He could just be an ambulance chaser (a rather slow one after 16 months) I would call your insurance and ask what they know about him and why he has your details. Are you in a motoring organisation like the RAC that cangive legal advice? If so use them as well.

Any contact you get from anyone about the accident should be passed on to your insurance company to deal with, if it's genuine they will sort it, if not they will ignore it. Either way don't waste your time/money calling the guy back.

It's usually a stipulation that any correspondence should be forwarded unanswered to your insurance company so you better abide by that.

As far as the claim is concerned, it's very significant that they have said that you are not to blame IMO. This would seem to mean that they have found a cause for the accident and you are not it. I would first contact your insurers to get the details of your appointed uninsured loss recovery team. The ones who have contacted you might be them but your insurance company will have an appointed one so check with them before responding to anything.

If there has been a cause of the accident determined, and some person or organisation/authority is found to be at fault through an act or omission then you have excellent grounds for lodging a personal injuries claim (and for your bike). You have 3 years from the date of the accident to start a compensation claim so you're well-within that. Talk to your insurers first, and see what it is they know.
