Possibly got a tricky one i'm thinking of how to sort out, if anyone here works in a bank they can shed some light on it.

earlier this year when i was settled into work and got myself financially ok i took a loan out to pay for my bike etc ( i could of saved up but i wanted to be on the road this summer and not wait a year )
with the money i was earning i'd have no problem paying it, infact i could of quite easily paid it in half the time.
when i took it out i also got the 'insurance' but never really read it properly.
soo about 2 months ago there were rumours going around work saying they are getting rid of all the agency people, which was me even though i'd been working there nearly a year which is usually the time they gave you a proper contract and whatnot.
anyway with the economy in the shit and everything they were starting to get rid of the agency lot ( this is hundreds of people on the site) who act as a buffer for these sorts of things anyway.
but instead of making us 'redundant' what happened was they were actually sacking us for the smallest things, this didn't just happen to me. in all the time i worked there, i had 1 sick day off, which they used against me and other shit like if i wasn't wearing a part of my uniform properly blah blah
anyway me and a few others ( now hundreds i've heard) have been fucked off but i doubt everyone has actually been sacked for petty shit like that.
am i still entitled to claim on my loan insurance if i was sacked?
i have the forms for it but not sure what to put, how much do they look into it?
there's even a part which they need the employer to sign, which is handy as they are based in luton, fooking miles away Rolling Eyes
is it worth blagging it or can i still get help even though i was sacked?

abit of a dodgy one and i don't want to do anything illegal but at the moment the natwest site aint working for me and no one in my family knows shit Laughing
just want to know where i stand really, because i can't afford to pay it again and i'm so far into my overdraft it's utter shit.

help! Surprised

"when i took it out i also got the 'insurance' but never really read it properly. "

Now would be a good time to read the small print.

It'll have various terms and conditions about how long you had to have been employed for and how long you have to be out of work for before you can claim from the insurance.

Because i wasn't planning on losing my job i thought i'd have it 'just incase' like i did when i took out my 2k overdraft, glad i did!
they asked me some questions before sending out the form to me, i just highly doubt i'll be covered because i got sacked and thats where i'll be fucked if it's true.

and selling the bike aint an option, the ps3 is already on ebay Laughing

All you can do is pop into your local branch... lets face it they even say they open on a Saturday..... To see what they say.

You could also take it up with the agency and see what they have to say about how you were treated by the company. Although to be honest i don't think they will be able to do anything.

If you told Nat West you were a agency worker, it could be that you were miss sold the ins part of the loan.

Hi

One thing strikes me. To be sacked they must go through a disciplinary proceedure. Sounds like they have not done that, and as such it would probably count as unfair dismissal.

However that depends on who you were actually working for. Whether that is the agency or the bank.

All the best

Keith

the only "disciplinary proceedure" i had was them telling me my place was being 'reviewed' i didn't have to work less hours or anything like that, everything was normal.
i worked at Toyota, but was being paid by the agency.
i know working for an agency means they can do what the fuck they like pretty much, but all i want is to know i'm not going to be financially screwed while i'm out of work. Crying or Very sad

Hi

In which case it would seem you haven't been sacked. You have effectively been made redundant by the agency. Only issue is whether the loan repayment insurance covers you for loosing a short term contract job.

All the best

Keith

Hiya

To be honest mate , I would say it doesn't look great for You. Most loan insurances stipulate that You must have been directly employed (NOT agency) for at least 6 - 12 months (Time depending on provider) , However I would suggest that You read the T&Cs. If You did tell them that You were employed by an agency , and thus have been missold the insuranjce product , take it up with the CAB and also the FSA (Financial Services Authority)

i think i'll try playing it dumb, on the form i have, on the bit where you sign it says "to the best of my knowledge this info is correct blah blah..."

other problem i have is who the fuck signs it, there's a page for the 'employer' but they are based in luton (3hr drive) , and i don't really want to post it. Confused

at least my ps3 has sold, yay a few more weeks without being fucked Laughing

Agree with Keith, you wouldn't have been sacked. I used to work for an agency and part of the contract with them stated that they had "no obligation to provide work for me". It's shit, but not a lot can be done about it Sad

Luckily I got a permanent job in the same place, but they are now getting rid of hundreds of agency workers in my building just like that (one guy did get sacked, because he opened an email on team leader's computer saying who was being let go that Friday, then he told them all).

As Hoffy says, read the T&C's carefully. Hope you find another job soon though, and don't have to worry about the insurance.

i'm with Natwest i don't know if that'll help but maybe you know what there like?
