Today i called around at an exes house to collect some of my property (Electronics)...

She kicked up a right fuss but I just told her I was taking what was mine. She then proceeded to lock me in and call the police.

I struggled with her for a minute or two to get the keys but then gave up because she complained I was hitting her, which I wasnt i was just trying to get the keys from her.

At this point the police are on the way and I cant be arsed with hours of talking to coppers, and i'm locked in. I told her to let me out or i'll break her shit, she didnt let me out so I did break a few things.

She called the police again demanding they get here now because I was hitting her and breaking things. The 'hitting' was me prising the keys from her hands and pushing her into a wall. I managed to get out in the end and a police car and van with the lights on were just heading up the street.

So, what's the outcome here going to be? Doesn't look too good for me... yes i broke shit and shook her up a bit but at the end of the day she locked me in, which she didn't need to do, to prevent me from taking my own property.

Can i retort with false imprisonment if she is going to try the criminal damage/assault route? Up until this, i'm pretty certain the police would have just told her an arguement over property is a civil matter and to talk to a solicitor?

That would be construed as common assault. Damage to property is criminal damage.
I would say that you are very likely to get arrested and charged for that unfortunately. Some police forces take a zero tolerance approach to domestic violence. Going off what you said you've not done anything excessive but she may say otherwise.
If you get arrested you'll just have to be totally honest, give your version and hope for the best. If you need to collect further belongings i'd make prior arrangements with your ex, and take someone with you as a witness if case she kicks off again.

did she LET you in the house?

if so then she let you in the house then locked you in.
no marks on her etc etc it was all just a big show so that you dont go round again.

breakups are a pain for both sides regardless of who was at fault.
sometimes its best to just leave your stuff and karma will get there in the end.

Well tbh im hoping the false imprisonment negates anything i did becuase it absolutely wouldn't have happened if she hadn't locked me in for ten minutes. Don't think it works like that though really.

Well - given that they are almost certainly going to side with her, and if she presses charges you will receive a criminal record - I would say:

You are in a bit of bother now ... but no real biggie if you work outside of the government or military.
However - the future is a bit bleaker... ... the way this country is going with removal of civil liberties and the over reaction to terrorism - you wont even be able to get a job as a road sweeper with a criminal record.
Almost every job I have had in the past 5 years has required a clear Criminal Records Check certificate.

or have I gone all political ?

You should have just sat down and waited for the police to arrive and either explained there or down at the station rather than incriminating yourself by damaging her property.

Once they figured out you hadn't actually done anything she may have been done for wasting police time (but doubtful).

As long as it doesn't affect my immigration application in 5 years to Australia then i'm not too botherd. This country is a joke.

Couldn't climb out of a window because its the second (top) floor of an apartment building.

Of all the citizenships I have (and I have quite a few) , there is always a question on the form asking if you have a criminal record and there has been a box giving the country you intend to go to the authority to ask the UK government if you have a criminal record.

I don't have Aus citizenship though , so they might be different



My cousin was denied HK citizenship because he had a UK criminal record about 18 months ago...(FYI it was drink driving and driving while banned).


Having had a look .... hold on don't you research such things first the Aus government says

* having regard to the person's past and present criminal conduct, the person is found not to be of good character

Substantial criminal records

Looks like a maybe , common assault/GBH battery and such might or might not be considered as application denied.

say nothing..you went there to get your stuff she went scatty and locked the door,you calmly said may i leave with my possessions she said no,im going to fuck ur life up and stared smashing things up.

no witnesses,no marks,why would u go into someones house lock ur self in assault them smash up there stuff and stay long enough for the pigs to arrive?

Won't happen in the UK.
For a start he has no proof. If his ex has the slightest bruise of mark on her from him prising the keys from her hand and pushing her against the wall then this will be enough for an assault charge.

Well ive just called the police and the woman i soke to was actually really understanding about how theres obviously two sides to the story and that locking e in was clearly not a smart thing to do and will not be in her favour... and that also me getting in touch to try and reslve it will only be in my favour, so...

i've left my number and will await to hear from the copper.

Like has been said here alot of it is her word against mine and visa versa.

Bloke in work had a similar situation. His missus wouldn't let him leave the house and clawed his face so he pushed her off. She hit her head and told the police the clawing to the face was retaliation! Anger management for him now.

I wouldnt put much faith in our boys in blue helping you out, Ive yet to have a positive experience with the 'arseholes'.

Your seeking some kind of understanding from the peope who upon finding you splattered across the road after being hit by a car will breathalyse you in the hope to get a conviction.

I was unfortunate enough to be in the wrong place at the wrong time 2 weeks ago where I was stood at a bar with my sister and I was attacked from behind by 2 or 3 individuals. Bearing in mind I had been there ten minutes and hadnt moved from the same spot I presume myself to be actually pretty innocent. Well, after being pulled from the floor by the doormen and thrown outside I was threatened with arrest for causing trouble (I think they called it section 5) my offence was standing there removing the blood from my face. When they realised I hadnt done anything they asked me if I wanted to press charges, whilst at the same time one of the offenders was stood right in front of me threatening my sisters safety if I did.

You have to be careful exactly what you say to the police if you're interviewed, they may still issue a caution if she doesn't press charges, unlikely if there's no physical marking on her.

If when interviewed by police you admit to doing anything that could be construed as violent then that's it, they can do what they want with you, issue a caution or final warning or whatever. If you're over 18 that's with you for life, even if it does get spent after a few years. Certain immigrations refuse criminal records totally, but you can get pardoned and get around it that way, it's difficult if it's happened recently though.

I got a caution when I was younger because someone reported me for attacking them, ofcourse my actions were a reaction to theirs. Problem is I admitted what I did in my statement, it didn't matter that it was a reaction, they cautioned me. I should've just denied it as it was my word against his, and it would've had to go to court if they'd really wanted to get me done, most ppl would chicken out for something so minor I think. Ofcourse this isn't explained to you before you screw yourself over. Thankfully mine was juvenile so is gone for good as far as I know.

So I got a phonecall at 7.30 this morning from the female copper who was dealing with the case (Great, women in alliance) asking me to go to the Police station at 11 and told me i would be arrested when i got there as a formality.

So I go, get arrested, searched etc, on to the interview.

She's all in my face about why I resorted to physical violence and shit and trying to talk down at me so what I did was I paused the tape and wrapped my hands around her throat and told her basically if she didn't make this go away I was going to have someone find out where she lived and murder those closest to her. She was shitting bricks at this point and nodded to let me know she understood. I unpaused the tape and we carried on, her being ever so timid and cautious not too accuse me of too much.

All said and done we left, went to the desk, she had a word and told me it's dealt with, the best she could do was allow me to leave with a caution as not to raise too much suspision.

This wasn't good enough so after we left the station I took her around the side where nobody could see and started laying into her; A few swift digs to the abdomen and kidneys for good measure.
She fell to the ground and I walked off laughing.

A good result I say Thumbs Up*

*Not entirely true, but the end result was that I left with a caution.

A caution is not good, Mad i got one a couple of years ago and when i went for my current employment i had to have a search done ,this came back with this caution on Crying or Very sad i went feckin mad as it had not been explained to me that accepting a caution was as is,i thought it was a slap on the wrist,and it stays for 5 yrs,i phoned some place to query it and got no where Confused

But Oz are very strict on letting people with any bad history in which is kind of ironic Smile
My friends application was turned down, because he was involved in a nasty pub fight when he was younger, But he was allowed into NZ which I think gives you a free run of Oz eventually anyway.
