Right basically, the same old same old with the DVLA. Basically my tax ran out on may 31st this year, but due to having an accident and the bike being smashed to pieces i decided to declare in SORN. Now i bobbed the letter off and thought nothing more of it.

And Guess what 2/3 months later, the good old DVLA decide to send me the age old letter of, i have failed to TAX/SORN my bike. Sent numerous letters out, when i recieved their £40 and then £80 request. They were sent recorded and i have copies on my computer.

And basically today, i have a letter from some Yorkshire debt collecters saying they want £80 otherwise they will clamp my vehicle! now i for one will not be paying the £80 because ive done everything through the book the DVLA has requested, yet due to their fuck up, they are now trying to get £80 out of me.

This is the second time i've had problems with them for the same matter. Last time it was took to Bolton crown court, where i ended up with a days wages and travel costs back.

Suggestions please?

Fill the form in properly.

If you did it on line or registered post there shouldn't be a problem like last time. Just get all your evidence together and take your time in court.

So what would be the best course of action now then considering the DVLA have sent it to a debt collecters? Don't see why they need to use bully boy tatics for such a small sum of £80. Do they not make enough money from robbing mugs who do fall for their tricks?

I can see it being their word against mine, i have copies of all the corrospodence i have sent them, my current bike is fully taxed so im not a tax evader. Also the said bike thats part of the dispute is not going anywhere as its a frame, with other bits in boxes!

When one of my bikes went up in flames, the tax disc was toasted obviously, as I was living in student halls at the time post wasn't always delivered promptly or at all and the Tax online website didn't exist. Anyway I didn't know when the tax expired due to a vapourised tax disc and I never recieved a reminder, curiously one of the first things on my mind after my bike was incinerated wasn't "ooh I better declare it SORN now", so the first thing I got was a letter demanding £80 for failure to tax or SORN.

Thing was no matter who I spoke to there was apparently "no right to appeal", so no matter what circumstances, what excuses you pay the fine end of story. Seemed totally illegal to me but I couldn't be arsed going to court so paid it, wouldn't let it happen again though.

You need to scan the ORIGINAL penalty notice and the letter from the Debt collection company and forward them to me along with the recorded delivery slips. Then I'll prepare you a letter to send to both the Debt collectors and the DVLA.
