If I was hit by a car being chased by police.....

What would happen?

Say my car/bike is damaged, it's not my fault, I'm not insured fully comp.....can I claim from the police? Or do I end up out of pocket?

This hasn't happened, was just thinking about it....

You'd probably claim off the guy who hit you , at which the insurers of that person (if they had insurers) would pay out to you , and they would then probably persue the person that hit you for the money you were given as a result of the crash. As it would be driving outside the terms of the insurance?..

Nope, it is the person that hits you, not the chaser as the person could always stop and so therefore not be chased and avoid the incident.

Ok, I'll set the scene.

I'm driving home one evening, and hear some sirens coming up from behind me, so I pull over, or do what I can to make the way clear.

I see a car being pursued by police. This car then hits into me due to poor driving or some other reason, and then carries on driving, police continue pursuing the car leaving me sat in my wrecked car, with no numberplate etc. All I can tell you is I was driving at '17.30' on the A1, and I was hit by a red car being chased by a police car....

What would I do?

I'm not insured fully comp, the driver who hit me a) I don't have his numberplates, and 2)Could be stolen etc etc.

You contact the police and request details of the other driver.

Just as you might try with any other hit and run, except in this case it's more likely the Police would be able to get their details (ie, if they were caught).

It would more than likely be from the Motor Insurance bureaux, same as with any other uninsured cock.

What if it was stolen?

I wouldn't be happy with a claim going on my insurance because someone had stolen my car and stacked it into someone.

Similarly, what if the car was laid up and legitimately didn't have insurance?

I've got a feeling that in some cases the owner's insurance can be claimed against; definitely 'wrong' to my mind, it should be the driver that's being claimed against.
Not to sure on the specifics of how it can work in such situations.

You would have to contact the police to inform them of a failure to stop/report an incident, and then to see if they will give you the details of the car that hit you, then you would probably have to try to claim off them. Chances are they wont be insured so you then need to try to claim from the motor insurers bureau.

I would say you have a long fight on your hands to get anything back.

Motor Insurance Bureau would be the one's who pay if the driver was not insured/vehicle stolen/jacked.
Part of everyone's insurance premium is put in this big pot for just such an occasion.
That's why I object having to pay for Police Camera Action DVDs at HMV, Woolies and cetera. I have already paid for the production costs. Sad

I am not certain on the amount of settlement you get logically it should be same as with a normal insurance claim but insurance companies are after all the masters of The Get-out Clause.

Insurance is never clear cut. A guy I worked with rear ended another car, shunting it into the car in front.

The guy at the front had to claim off the guy in the middle who then had to claim for both vehicles off the person who caused the accident.

In a multi-vehicle claim it's normally the last man on who is the Daddy.
It is difficult for him to be taken seriously if he tries to deny liability.

happened to me when my parked car was hit by a stolen car. I chased and caught the little toe rag and dragged him back to the scene.

The police took him away and my insurance company settled as a write off within a week. Got the xs back within 4 weeks from MIB which would have been the timescale for your TPFT claim to have been paid out.
