As some of you may know, we bought our eldest son a 49cc Hymoto mini dirt bike for his 6th birthday.

Now my OH's ex, who is jacks dad, is kicking off saying its illegal and inaproporate for a 6 year old and dangerous.

thats he's going to the solicitor and filing a police report and wants an MOT certificate for it, even though my OH emailed him saying it isnt illegal and we have private land for him to ride on, it is restricted,safety cut off switch and stabillisers and is EC approved,jack has gloves and helmet, but he still says its illegal and that its ridiculous,and still wants to file report with police and not sutiable for jacks age.

but as far as we were concerned you can ride on private land with the written permission from the land owner at any age.

Does anyone know a website where we can find out exactly what is legal and if the bike is in his age range and what we have to do to get him off our backs, hes causing alot of trouble and it is really upsetting my OH, can anyone please help.

The rulebook suggests the minimum age for competition is 6 so they consider it safe to not only ride but race at 6!

My sympathies to you, I know it must be difficult dealing with this (first hand experience)


Only advice I can give is remember the the OH's ex may not be doing this out of badness, he may well be worried about the kid getting hurt. My advice would be to try to compromise with him, to show it is going to be an activity in as safe an environment as possible.

Why not invite him along to observe, it might not be an easy outing, but may alay his fears and get him off your back.

As for age, regulations etc I believe you are within the law, however if he has joint Parental Control that may not count for much as it would come down to the opinion of the court. (doubt it would get that far)

The lad wants to ride the bike and enjoys it so get him to tell his dad next time he see`s him, surely he won`t upset him by saying he carn`t ride it. so long as he has his helmet etc on whats the problem and im sure if your on private land coppers won`t be bothered.

Won't make any difference what he has, the Court will say fuck all about the activities that a child does with one parent as long as what the child is doing is considered safe. The non-resident parent gets imput into things like a change of name, Religion, school etc but nothing like that. Trust me.

Surprised he is going to the Police rather than the Social Services.

But seriously, if it's on private land anyone can drive/ride anything at any age can't they?

He has no grounds for complaint and is probably hoping he can scare you off with threats of police (who have no power to do anything). More than likely he's just worried, but tough shit, it's not his decision to make, especially if the boy enjoys it!

I'm sure if you can find the relevant piece of legislation and email him a chunk from it with a comment along the lines of -'I'm no longer willing to discuss the matter.' He'll get off your back!

Not a people person are you swede? think of it the other way round... You're genuinely worried for your kid's safety and someone who doesn't have any real rights to you kid's well being* tells you to sod off and stop interfering.

Much better to point him at a bit of relevant info and then get him down one day to watch / join in and put his mind at rest.

* not saying sim2k doesn't care / shouldn't be supporting his partner & the kid, but the birth father obviously deserves a say in the kids life whereas sim2k is only there by proxy - ie. if not for his partner he'd have nothing to do with the kid.

This is a fair point Laughing I could have spent more time writing a balanced argument but I decided to spend the time looking for the laws on the matter Rolling Eyes

what pisses me off the most about this is he feels he is in his right to bitch about this, yet he brought him back in a car without a car seat last week and begged we didn't go to the solicitors etc.
