i had a slight bump today, we were going through thorne and there was a pedestrian crossing that was on red and line of stationary cars waiting so i decided to filter down the side of them to the crossing as I did a car came out from a side road between the cars and into our path, im sure he didnt look right only left to the lights, unfortunatley i hit his front wing, i wasnt going fast but i just wasnt able to stop before hitting him

theres hardly any damage to my bike from the accident, its cracked the nose fairing where the indicator is and the indicator is now loose (im sure i can fix it all with pastex or similar), and the car driver(car i hit) snapped off my wing mirror trying to help me get my bike upright again as i didnt drop it just lent it right over other wise the damage would have been alot worse. he has dent and scrape in his wing.

we swapped details, neither of us have addmitted fault and the police didnt attend (they have been informed), there was a guy who stopped and offered to be a witness but he is saying i was speed past the cars.

I have called the driver of the car i his and offered to fix my bike and he fixes his own car with out going throught the insurance. he has gone off to think about this.

if it goes to the insurance how do you think it will pan out, has any one else been in a similar situation. i have included a diagram

Tricky one, he shouldn't have pulled out, but you shouldn't have over taken by the junction. I'd personally avoid the insurance route, you'll probably both loose 50/50.

Any witnesses for either side?

one who stopped to help an he was saying it would be 50/50 but he also said i was going too fast

and girl friend who was on the back who can back up me up and say i was travelling slowly past the cars and also that he pulled straight out rather than coming out slowly and looking

Girlfriend's no good as a witness, she knows you. I'd expect 50/50, if you can get away with not going through the insurance, that's the best way.
