From your description it seems fairly cut & dried - the only grey area i can see is the 'will fit 32'.
(I'm not even going to mention that you can't spell 'waist' correctly)
However, eBay/papypal seems (currently) notorious for siding with the buyer - so they may honour his dispute (I assume he has opened a dispute).
My argument would be that the size is clearly stated in the advert, the fact that they don't fit him is not your concern - i've seen plenty of size 20 fat birds shoe-horned into size 8 clothes, so perhaps he's trying to convince himself that he's still a skinny and not a fatty (like myself). ____________________ Space Monkey #7

If the buyer is somewhat Paypal savvy he will of said they're not as described (even though they are), in which case Paypal will tell him to return the goods at his cost within 10 days and provide a tracking number. He will then get a full refund including the postage costs that you paid.

I personally find bike gear notoriously difficult to get the right size in, to the point of giving up on many occassions and just walking out of the shop! I'd certainly never risk it on Ebay...
I'm a size 11 shoe yet need a size 12 bike boot, and even these can sometimes be too tight. I'm an XXL in most other normal stuff but end up buying 4XL or even 5XL in bike gear - so annoying!
Due to this I'd say it's the buyers own risk and therefore he should just give the money and resell the item himself if he doesn't want it. However since Paypal/Ebay can be complete gits in giving the seller their money, it may be worth offering the buyer his money back minus any P&P costs so you aren't out of pocket. Reason being you've given more than enough info on the size of the trousers for him to have made a judgement wether they'd fit him or not...

What is a payment hold for an eBay item?
It’s when PayPal temporarily holds a payment you receive for an item you sold on eBay. The amounts held will appear as Pending in your PayPal account until we release the funds. You still have access to all other funds in your PayPal account.
When will PayPal release the payment hold for an eBay item?
Your funds will be released after 21 days. We may release funds earlier when one of the following occurs:
The buyer leaves you positive feedback on eBay
3 days pass after we confirm the item was delivered*
If you receive a dispute, claim, chargeback, or reversal on the transaction subject to the eBay item hold, we may hold the payment until the problem is resolved, even if the claim, chargeback, or reversal occurs after the hold is released.
Why would PayPal hold one of my payments?
To increase marketplace safety, we may hold payments that seem risky. Here are some common reasons for holding payments:
You have been an eBay member for less than 6 months, and you sell an item for more than $100, or
You have an eBay feedback score of less than 100, and you sell an item for more than $100, or
You have a Buyer dissatisfaction percentage** 5% or greater than 5%, or
You have an average Detailed Seller Rating (DSR) of less than 4.5, or
You have received fewer than 20 Detailed Seller Ratings in the last 12 months, or
You are listing your item in a high-risk category such as gift certificates, video games, cell phones, computers or consumer electronics.
PayPal doesn’t hold payments for eBay items if you meet the following:
You have been an eBay member for 6-months or more, and
Your total Feedback score is 100 or greater, and
Your Buyer dissatisfaction percentage** is less than 5%.
Or
Your average DSR is 4.5 or greater and
Your have received 20 or more DSRs in the last 12-months
Your buyer dissatisfaction percentage is less than 5%
How can I avoid receiving an eBay item hold?
Here are some things you can do:
Improve your DSR feedback rating
Follow the PayPal best practices to reduce buyer disputes, claims and chargebacks
Resolve all disputes, claims, and chargebacks quickly
I’m a new seller. Will payments I receive be held?
If you are a seller with an eBay feedback score lower than 100, but you have a record of good performance, you’ll receive payments instantly in most cases.
* We can confirm delivery if you ship the item with UPS, USPS or FedEx and either use PayPal shipping labels or upload tracking information from the transaction details page. This applies to transactions within the United States. If a payment is held, it appears as Pending in your PayPal account until it is released.
** Buyer dissatisfaction percentage is measured by adding negative events as a percentage of your transactions. Negative events include negative & neutral Feedback, Detailed Seller Ratings scores of 2 or lower, and disputes for items not received or significantly not as described. ____________________ My mum smells your fingers |

Sorry, I presumed he had already initiated a dispute as they were not to his liking. I'm not to up on them witholding funds as you are a new user (wtf?).
Anyways, I'd just email and him and ask him to try the damn things on, if he's happy release the funds, if he's not happy explain to you why not. Does indeed sound like a numpty IMO. ____________________ Current: ZZR1400

through paypal yes you can technically, even if the ebay description says no returns. Under paypal disputes its stuck through as a not as described unit, and then you have loads of choices of why its not as described, so he could just put incorrect sizing or something, or find a tiny bit of thread showing and call that damaged goods if he were picky enough.

See thats the issue with ebay now, as ebay and paypal are the same company and work together, you cannot list a auction without paypal being in the payment options, and if you do right no paypal in the auction they will remove it, been there done that too, wouldnt refund my listing fee's either the slags  ____________________ Past: '05 Peugeot XPS '99 Aprillia RS125 '94 FZR600R
