At the end of march my bike was reversed into outside a shop, a witness gave me the drivers details and i took hers, we were both sent statements to fill in and send back to my insurance which we did, also i have filled in police statements etc, but the police have not recieved the statement from my witness,

The problem is direct line have twice now accepted liability, once not long after the accidect where i was told they had decided to over ride the woman denial claim, and once about three weeks ago,

both times they told me i would be getting a cash in lue payment of £850 withing a fortnight which is the amount agreed between myself and thier accident damage assesor,

both times when i have called back after a couple off weeks they told me that they had retracted the offer because the woman that reversed into my back is denying hitting anything (although she is not denying driving the car or parking at the shop where it happened),

They have been messing me around for ages telling me they had not prosesed the witness statement or that it needed to be dealt with by a diferent office etc, But my insurance assure me they WILL pay out because i have a witness, and that they will keep on at direct line (the womans insurer) on my behalf,

The thing is what do i do if direct line keep messing around, refusing to pay out?

Should i get solicitors involved, or one of those ambulance chasing/ damages companies or something?

Its doing my head in now, its dragged on so long I am starting to lose heart in the bike, it was realy tidy with candy blue paint with a red flip and mint undamaged bodywork (an achievement for a 1989 cb1) now it just looks like and old scratched up shitter with cracks in the seat cowl and odd coloured indicators (meant to be nice smocked lenses).

Did they ever agree in writing?

What Sickpup says. If you have a letter from them admiting liability then ring your insurance people up and gee them into action. They need to persue it on your behalf.

I was driven in to a few years ago by a woman in a Mini, she admitted there and then it was her fault - swapped details etc then her insurance company Direct Line started questioning it all and offering me 50/50.
I stood my ground even though there were no witnesses but decided to counter offer with 75/25 my way or go to court. They eventually backed down and gave me 100%. It took over 18 months though. Evil or Very Mad

As above, have you had the admittance in writing? You've got an even stronger case than I had so I'd suggest you tell them to offer 100% or see them in court. Thumbs Up

the first time they agreed to pay out i recieved a letter to that effect as did my insurance, the second time it was an over the phone thing. I have just hand delivered a police statement for my witness to fill in as the police still havent had a reply to the two they have sent (or supposedly sent) and can't accept a copy of the one she has already sent to my insurance as it has no court outh section to sign..

The woman who hit my bike has denied it from day one both to her insurance and the police, and as i didn't see it happen i can only go on what the witness told me, like i said the first time they agreed to pay out was them over riding the woman

A couple of years ago I told a claims handling company to 'stop pissing in the wind or I'll have you done for fraud. I know what your insured stated happened, I have a copy of it where he admits fault so settle the claim or I'll have you'.

You have it in writing, what's the problem here? Just issue proceedings.
