Civil law requires proof to within a balance of probability.

I'd guess the Judge decided it was more probable that the incident did happen than that it didn't.

On reading the article, I would also conclude that the incident did happen. How appropriate it is to be awarding damages of E7,000 is another matter entirely.

I truely give in.

Between pathetic money grabbing whingers like her and senile no-nothing judges who have spent their entire lives in their own protective bubble away from the real world it's getting to the point where you dare not say good morning to a stranger in the street for fear of them tripping over and suing you for every penny you have.

How has the country turned away from pride and fortitude and just getting on with it to this state of affairs where people are more than happy to make themselves look so weaselly for a few dirty pounds?

Regardless of what country it took place in, things like this just shouldn't get to court, let alone be decided in favour of the plaintiff:

The judge should've thrown out the case. I would have.


I'd love to see the government come to their senses and prohibit illogical claims.

Trip over a paving slab = Look where you're going.

Scalded yourself on hot coffee = Did you not learn coffee is a ''hot'' drink and it could scald you?

Seems people cannot take responsibility for their own mistake and they'd like to blame someone else and get money for it.
