PostPosted: 08:42 - 30 Jul 2009    Post subject: Withdrawal symptoms.... Reply with quote

It's been 3 months since i last rode a bike, i believe i'm now getting withdrawal symptoms.

Last night i dreamt i went bike shopping with my dad, sadly all the bikes were just frames with fairings on. My dad was inspecting a FJR (which was as big as a car), i warned him not to touch it, but he did - and sent it toppling over, knocking down every bike in the shop like dominoes!

Despite all that, i came home with 2 bikes - a RS125 with a RS250 engine (strangely, it was also a triple, with the cylinders arranged like a Merlin engine), i also purchased a supermoto with a gixer thou engine in it.
Oh, the wheelies i performed!

Later, i hid in the wife's MPV, waiting to catch some local scrotes kicking it. They did. I leapt out and beat the living fuck out of them.

Note to self - do not eat cheese before bed.

Sick

Go. Buy. Bikes.

Jesus.

If you're not banned you've no excuse. Even if you are banned you should still own one to lavishly treat.

I haven't been out on 'my own' bike for about 2 weeks now, I think, as I sold my Bandit and bought a KLX (which isn't OTR yet). I did have a dream I had the Bandit back but with a 300zx twin turbo engine in it. I had a 300ZX TT before. The bike felt super smooth especially when the turbos kicked in.. if only it was real Laughing

Just put mine up for sale. Reckon I'll be in the same boat soon Sad

Pre-emptively bought SBK09 for the xbox to try and stave of any withdrawal symptoms. Don't think it's going to be the same somehow.

I was about 45mg I think. Just finished my DD rehabilitation course. Apparently if I was 40 or below I would have been asked if I wanted to give a blood sample. Depending on how long the doctor took to come I could have been fine (thought i was driving anyway to be fair)

so a simple refusal to provide a breath sample and demand a blood ample be taken, might have actually saved your license! OUCH!

gutted for ya mate!

Got 12 month ban (25% off with DD rehabilitation) and £460 fine reduced from about £800-£900 I think with mitigating circumstances. There was a guy on my course who was over double and pretty much got the same as me. The unluckiest guy was caught the morning after a night out. His van was overweight and he was pulled over and breathalysed as he looked 'pretty rough' anyway his was around 38mg (breath) and didn't want a blood sample (he didn't know at the time there was almost a way round it with that low mg/breath)

12 months ban and £500 fine. Put him out of his job and is currently in the middle of a divorce. Ouch!!

Also the only way out of it was to lie to the courts and say I had my drink bought by a friend who spiked it with a shot of vodka etc, meaning I was unaware I would be over the limit.

You can't get away with a DD charge if you plead guilty. I was over the limit and had to.

Been over a year for me and the R1 now.
I can see the light at the end of the tunnel now though, and I started her up today after finishing the engine rebuild. I'm on edge in anticipation of riding her again.

Always wondered how it'd go if you claim you must've had a drink spiked, I suppose they'll still say it was your responsibility to be aware of exactly what you are drinking, still not all alcohol is detectable in drink so you could genuinely have no idea, and that's your life down the pan once caught.

I'm not sure if you can actually refuse a breathalyser test at the roadside, I think that is an offence to refuse to give a sample. But you can ask for it to be done more accurately later with a blood test in addition, often happens on police shows where they get off by doing that.

I believe you say you've literally just had one, so it won't be accurate.

Thus giving you some extra time to metabolise what you have. Adrenalin is a savage mistress.

I heard some chav rambling on about a penny under the tongue. Or chewing gum.

Either way, don't blow hard Wink

if you say youve just had a drink they will wait 20 mins before administering the test. if you refuse then they will arrest you for refusing to provide a sample.

You can't, and even if you do agree to if they think you are not trying hard enough then you can still be done for failing to provide a sample.

Recent case where the police used the roadside breathalyser incorrectly (putting in a one way valve wrongly) resulting in no sample and then charging him with failing to provide a sample. He was lucky enough to be able to prove this in court.

https://www.telegraph.co.uk/news/uknews/5901258/Motorist-cleared-due-to-faulty-police-use-of-breathalyser.html

Daily Telegraph wrote:

Motorist cleared due to faulty police use of breathalyser
A motorist suspected of drink driving has had charges of failing to provide a breath sample dropped in a case that could have implications for thousands of other drivers convicted of the offence.

By Christopher Hope and Heidi Blake
Published: 8:00AM BST 25 Jul 2009

Leon De Jager, a 31-year-old IT consultant from north London, was astonished when he was charged with failure to provide a sample after blowing into a breathalyser machine exactly as was told by police.

But the case was dropped after Driving Defences, a specialist road traffic law firm, proved that officers had incorrectly fitted a one-way valve into the breathalyser machine, making it impossible for the driver to provide a sample.

Every year thousands of motorists who are suspected by the police of driving while under the influence of alcohol are banned from driving because they fail to give a breath test at a police station.

Failure to provide breath test when asked by a police officer carries an automatic two year driving ban.

Mr De Jager, who had been stopped by police while driving back home from a friend's house late at night in May 2008 in his Renault Clio, said: "I couldn't understand it. It didn't matter how hard I blew, it didn't register my breath.

"The police thought that I was deliberately avoiding the test and charged me – I couldn't believe it. I even asked for another chance so that I could prove that I wasn't over the limit.

"But the police weren't interested. They said that I'd had my chance. They just wanted to charge me with failure to provide."

The case against Mr De Jager was dropped in December last year when legal experts at Driving Defences asked to see the valve through which he had attempted to give the breath test.

A simple DNA test carried by the Crown Prosecution Service revealed that he had been blowing through the wrong end.

Martin Hammond, a principal at the firm, said the case meant thousands more drivers may have grounds for appealing against convictions.

"The problem lies in the mouthpiece," he said. "It is designed to allow air to pass in only one direction. But we have shown that with a breath testing machine used by many of country's police forces, the mouthpiece can easily be inserted into the device the wrong way.

"This means that no matter how hard they try, it's impossible for innocent motorists to provide a specimen. If they are charged with failure to provide a sample, drivers can face more serious consequences than drink driving itself.

"Thousands of motorists could have been wrongly convicted and they can now appeal."

A survey by The Daily Telegraph found that some of the biggest forces in the country, such as the Metropolitan Police, use the same breathalyser. Out of 32 forces surveyed, five forces used a breathalyser with the same mouth piece. The others are Essex, Cheshire, Suffolk and Sussex. Eleven forces declined to say which type of breathalyser they use.

At least 17,189 motorists were tested across the five forces last year, although the number is likely to be much higher. The Metropolitan police used the kit to test around 12,800 people who were arrested after failing or refusing a roadside breath test.

Since 2001 around 8,000 drivers a year have been banned from driving for failing to "provide a specimen for analysis (breath, blood or urine)".

In 2007, the last year for which figures are available, 8,232 drivers were banned.

A Home Office spokesman said: “Type approval of policing equipment such as alcohol breathalysers is a rigorous procedure designed to ensure that readings produced by a device are consistently reliable and accurate and so can be depended on for evidential purposes”.

A spokesman for the Association of Chief Police Officers said “no problems or concerns” had been raised about the mouthpiece generally, “but as with any piece of equipment of this nature, it is important it is used in accordance with the training provided”.

All the best
