injured at work where do i stand?

hi i work as a mechanic and whilst undoing an axel bold the spanner slipped as bolt came loose
my hand went back and caught the petrol tank strap cutting top of hand shaving the bone and cutting through 2 tendons so no use of 2 fingers!
servere nerve damage i hyave no feeling in my hand what so ever the docs say it may come back or may not if the feeling dosnt come back i cant work as a m,echanic any more as the 1st ide know of catching my hand would be seeing it ripped off!
i understand there is no blame but it was at work so would i be intiteled to anything?

sorry to hear about your hand.

hmmm hard to say. most places only pay out if someones to blaim Confused id phone some accident claim places and see what they say. worth a try

You say there is no blame, but look at it this way: Something caused the accident. The cause of the accident must be ascertained first, then liability can be formed. The first question would be were you supposed to be doing the job? Did you use the correct tools, and did you have the necessary training to perform the job? Who asked you to perform the job? Was a risk assessment made before the job and were you aware of the risks first?

Thing is, in my experience, stuff like this only comes out after an accident unless you have some Nazi H&S officer in the company (I spend my time avoiding her at my work!)

If you consider you were asked to do something outside of your training, or you hadn't been given the correct tools, you could probably blame someone regardless of the risk assessment.

But it all hinges on whether or not you want to upset your employers, really. The money has got to come from somewhere, after all.

Employer would have to have noted injury in your work's accident book. If not then they broke the law.

If severe then the injury may have to be investigated by the HSE. Maybe worth giving them a 'phone call for clarification.

Try talking to your employer, if not look into the claims direct type people.

im fully trained to do the job was useing the right tools not worried about upsetting the boss as i wont be able to work as a mechanic again the op hasnt worked i have no use of 2 vfingers

Can't realy see how its your employers fault, however im sure there will be some bullshit law somewhere making it his fault.

However if you have life insurance have a look at that to see if it covers you for any sort of injury.

Of course you have a claim. Your employer will have insurance to cover incidents such as this.

Your employer at the time should of by law had employers liabilty in force, and as such you would be covered at least in theory we all know how nice insurance compaines are Smile i run my own business as such have insurances in place EL and also PL i pay my premiums i have no problem with people claiming off my insurance as long as its a legit claim thats what i pay my money for at the end of the day, touch wood never had a claim in all the years i have been going, but law of averages would say one day they will be claimed on, in my mind its nothing personal just business. people do get shitty about such things but personally i cannot see why maybe have a chat and see where you stand in a informal way.

i was useing a long ratchet and socket and 3" extention couldnt use an impact gun no room for it as ramp was in the way
