Royal Mail Claim - Small Claim Courts, any chance?

Hi,

Basically, something I sent in the post to a company got damaged on the way. The company sent back all relevant details and evidence, and I'm £50 out of pocket. It was sent using special delivery and I have the proof of postage, as well as the original bubble wrap that it was sent in (to prove adequate measures were taken the prevent damage.

Unfortunately, I don't have the original plastic bag, which offered no protection, it was originally in, which under the "postal law" (I forget what it's called now), means they don't have to pay a penny of compensation. I find this completely devoid of the fact they damaged my item, have provided everything else, proved I took measures to prevent damage to said item.

If I took the Royal Mail to the small claims court, do you think I'd win, since it's not my fault, that an irrelevant part of the packaging hasn't been returned to me?

Royal Mail are unable to deliver letters properly, what gave you the idea that they'd be able to cope with something worth £50 that could be damaged?

It obviously wasn't packaged well enough as it got damaged in transit. I'd be complaining to the shipper.

Thing with small claims such as moneyclaim.gov is it costs £30 to start proceedings and then the further along it gets when they just ignore it (which they probably will) it costs you more and more until you'll be looking at paying out twice was what you're claiming back. You can include costs in the claim but when you don't get any of it back it's not worth it.

Hold on, you have the original box? And bubble wrap? should be enough.

Sounds to me that they have put the first obstacle in your quest for compo and you have caved. Tell them the original outer layer is irrelevent to the protection. They only want the outer layer to tie it up to your proof of posting, however the "PROOF OF POSTING" is just that. They would need to prove that this was a different package, not you to prove it is the same.

Stick in with them, keep asking for supervisors, and BTW the Royal Mail website says you must retain all packaging. However a plastic bag over your packaging can be described as waterproof labelling

Have you tried rather than messing around on the phone. Call into the local collection office and talk to them
