Faulty bed, can i do anything?

Right guys, bought a bed from https://www.jjbeds.co.uk/index.asp 26/09/2008 which cost me £204.99 & a few months back the frame bent, i don't have kids so there's been no jumping up & down on it, & i don't throw myself into bed so the only thing i can think of is over time it's been given in until it finally decided to give up.

Phoned the shop & they said the bed's are only covered by a 3 month warranty.

Is there anything i can do as it's just sitting there in the corner of my room & when you buy a bed, you expect it to last a good few years.

Should of gone to our resident bed man (wizzzard) Wink

I was under the impression that EVERYTHING sold/bought in the UK (provided it is new) is covered by a 12 month warranty under the sales of goods act. Obviously consumables aren't covered unless they are deemed/proven to be faulty/not fit for purpose.

Although, i remember reading somewhere (think it was our in house anti-government nazi, hetzer) saying that even though it is out of its 12 month warranty period, it still has to be fit for purpose, which obviously the bed isn't. If you can prove that it wasn't your fault (ie - a rather large rear end) then they are still deemed responsible (they being the bed people)

It isn't reasonable to expect a bed to last only 3 months of normal usage. The retailer at the point of sale has to take responsibility.

Thanks for the help, when i phoned the company, it was well within 12 months so hopefully i'm still entitled but how would i prove it?

Sale of goods act says that goods have to be fit for purpose.

There isn't a time limit on it. It's quite reasonable to expect a bed to last longer than 3 months, if it breaks that fast then it isn't fit for purpose so they're meant to sort it out (repair or replacement).

Give Consumer Direct a call to find out details of what you should do next.

Interesting. I got a refund store cred after 10 months for a pram that wasnt as discribed, to small for my 8 month old and apparently suits up to a 4 year old. The company that made it wanted nothing to do with it. The place I bought it send a courier and took it back, no questions I just send a pic of baby looking cramed in it and got vouchers back. So it can be done outside the time frame. Even a year.

If it's the frame that supports the slats that has bent its due to extra shonkey chinese imports that are flooding the country right now. There is a huge shortage of metal beds at the moment so companies are taking what they can get, we have had a few through like this and now won't sell them

You can definitely take it back as they are not fit for purpose ( they're not fit for feck all ) and three months is a huge pile of steaming horse manure Thumbs Up

You could also take the bent piece to a local independent bed shop and ask them to give you their opinion of it, maybe even write you something to that effect. Doesn't hurt to have a second opinion when dealing with these things.

The lesson to learn from this experience is never, never, never buy un-branded items of furniture such as beds from tinternet. You need to touch and feel such items in order to assess the quality of same. Your alarm bells should have sounded when you visited their website. It appears to have been written by a retard with absolutely no knowledge of beds. I had to laugh when I read their boast of top class service and proffesionalism [sic]!
I do hope that you made your purchase using a credit card. If so then the credit card company are jointly responsible for the merchantable quality of the goods and you should contact them if you get no joy from jjbeds (or whatever they are calling themselves this week). Three months warranty ? What a croc of crap.

I bought one of these december last year massive bed

Not had a problem with it and ive been suitably impressed with the quality for the price.

Just spoke to the company & told them the bed is not fit for the purpose it was sold, and you wish to have either a replacement or refund, under the 1979 Sales of Goods Act & they're still unwilling to refund. They said it was only up to 30 days guarantee anything after that & i could of damaged it myself to get a new bed....

Nice to see they ignore their own terms and conditions.



I'm pretty sure visa offer extra purchase protection similar to credit cards on their debit cards as a voluntry measure but none of the others do. If your card carried the Visa sign ringing visa themselves it is something to bear in mind if things don't work out.

Just give the company another call and say it's not fit for purpose and that you have 12 months statutary rights. If that doesn't work your next port of call should really be trading standards I think.There is a furniture onbudsman but they are toothless to say the least. Make notes of exactly what has been said to you and get their name as well.

The area they are in has hundreds of fly by night little bed firms ( and some decent ones ) so I wouldn't hang around to much just in case tomorrow they are called something else Thumbs Up

Has to be trading standards now I'm affraid mate. Only just noticed the date you bought the bed. Did you let them know a few months ago when it bent or have you only just informed them?

Be sure to say that you stopped using the bed the instant you noticed it bent.

Don't forget to have that mystery back pain Wink looked at by the doctors, there's nothing that scares a retailer more than the chance of serious compo claim Thumbs Up

I sent them the email showing the bent frame on 13/07/2009, so well within a year.

Just filling out the form now.

Personally, I wouldn't fuck about with trading standards.

I'd write to them, saying that the bed isn't fit for purpose, and that you require a refund. Write "Without Prejudice" at the top of the letter, and say you'll accept refund of, say, £175 to allow for the years use you've had out of it. That offer is only good for 14 days from the date of your letter, after which you'll take them to court for the full amount without any further discussion. The "Without Prejudice" basically means that if you go to court for £205 plus costs, they can't turn up and say "look, he says here he'll accept £175"

While you're waiting, sign up at moneyclaim.gov.uk. If they haven't refunded you in that 14 days (make sure you tell them you're no longer with the same bank and a refund must not be made to the card you used to pay with), start a claim. It costs £30 or so but you add that to the amount you claim.

What I've done before to save the money is pick up the forms from court, fill them in, then photocopy them and send them a copy, telling them that I'll be submitting them to the court a week later if I haven't had my refund. That's usually enough to kick them into action.
