Hi the other day this fella on his bike knocked me of my bike and i explained it to my insurance and they think he is liable and they want to go ahead with lending me a hire bike, but they said i could end up paying for the hire bike if i lied about how the accident happened, and i thought about it and that means if the guy disputes what i said then i could end up paying for the hire bike because there were no witnesses its his word against mine? So what happens then....

Also this is the situation

i was riding straight i moved over to the right of my single lane just as i did he went to overtake me and hit me on the side. Now at the time he said i was indicating right and i was trying to go down a no entry road and he hit me as i went to go right which is wrong.. but even if that were what he told his insurance would he not be liable to trying to over take me when i was indicating right? regardless of where i was going i mean i could have been indicating right to park on the other side of the street? the fact is he was going over 30mph in a 30 he rode into me trying to overtake?

Just curious as to what you think i do feel partly responsible because if i am honest i moved over to the right of my lane and really i didn't need to and i wast really aware of him behind me and i should have been but really should he have been overtaking me?! i know i do it all the time but i never hit people!!! so dont do it unless you can do it right? right? bah!

It seems to me that he essentially rear ended you, he shouldn't have been trying to pass within the lane anyway and he should have been keeping a safe distance in anticipation of any moves you made.

If you were signaling right and he tried to pass on your right, that leaves him doubley liable. Finally, it doesn't really matter if you didn't see him, as long as you 'say' you carried out adequate checks. The onus in this case would be on the rearward rider having as he/she does; the best view, (I would've thought.)

Also, if you're fully comp, the hire bike should be covered although I'd check that first.

Hi

Irrespective of fault I would be dubious about having a hire bike. The costs of the hire bikes through insurance are pretty hideous should you land up having to pay for them (could easily be more than the cost of buying the same bike), and not a risk I would want to take.

So he clearly saw you indicating to turn, yet still decided to overtake you close enough, for a sideways movement of a few feet to cause him to hit you.....

Wonder how the hole in his foot feels.......

Bet the story he tells his ins co is nothing like that....

As the the ins and hire bike.

Sounds very much like standard stuff they will say to everyone to cover their backsides.

What sort of cover do you have ?
