PostPosted: 16:55 - 02 Nov 2009    Post subject: Car Crash, other driver had no insurance! Reply with quote

Was in the car with the Mrs, she pulls into a small car park used by the public, 4 cars can be parked either side, there was a car in the middle, the Mrs pull in to see it full, at this point we are stationary.

The other cars reverses, hits us and then we all get out to have a little argument over what the hell the other driver was doing. Damage was a cracked front bumper to my girlfriends car.

The other driver got out, she said "Sorry, I did not look" then proceeded to claim she had no tax on the car. Rolling Eyes She was Polish and did not speak great English, neither did her boyfriend who was in the backseat minding the child they had in the car with no child seat.

Anyway I got the insurance details off her and got the Mrs to do the admin bit. Told them to get her tax sorted asap and that my girlfriend would be claiming off her insurance, she said OK, no problems etc, and we all carried on with our day.

That evening my girlfriend text her her to get the ball rolling and the Polish girl called back to say, "Actually I am not insured on the car, but my boyfriend is, can we say he was driving and you can claim". The Mrs said no, but we can do a cash deal of £350, which is how much a new bumper will cost from a garage. She said OK and can meet on Friday.

I bet you can guess what happens next.

Friday comes, no contact, she did not pick up the phone, reply to texts etc.

The Mrs asks to pay up or she will call the police. She already contacted the insurance to tell them she had a crash earlier in the week.

Now problem is what can the Mrs do to get her car fixed? She generally takes a dislike to Polish folk anyway, this is just making her mad. What will the police do to them? And, what will the insurers do to them? Can they get fined? and car taken away?

What is the normal course to take?

call the rozzers. Simple. People like that (no insurance) don't deserve a break or a second chance. If I have to pay, they have to pay, and if they don't, let the law have them.

Your missus should be able to claim on the Polish boyfriend's insurance as stated under the Road Traffic Act. This was the case when I was knocked off my bike by an uninsured driver who was driving his friend's car who had insurance. I was fully comp and got paid out by my insurers who then claimed from the 3rd party though. It might be more difficult if your girlfriend is TPF+T.

This! People who can't be bothered to insure their cars cost everyone else money. If she doesn't have insurance herself then why wasn't her boyfriend driving? Bet she doesn't have a license either.

You should have just agreed to claim off her boyfriend. Now your stuck in the position that you knew you'd be stuck in when you decided to let them get away with no insurance.

You're having a laugh aren't you? Do you think that the police will be even slightly interested in investigating, especially when they hear that foreigners are involved.

Why should they? And I'm pretty sure that isn't legal.

Why should they? Because he wouldn't be posting on here asking for help otherwise, his car would be in the bodyshop getting sorted.

It's not like he's gaining from it, infact, he could also put in a whiplash claim against the bloke.

Or he might be being interviewed for trying to commit insurance fraud.

All the best

They actually would be quite interested, they only have to ask her if she was driving and if she says yes that's enough to charge her for driving without insurance and then there's the lack of tax too.

Lastweek an arse in a car came bombing down a single track road, I stopped, he didn't and tried to bolt down the side of my car smashing my mirror off. He stopped further down road saw the damage and legged it, the police have actually been pretty helpful despite me not having the full reg, when I get the full reg (which I will) they'll be following it up for failure to stop at an accident.

And Dom, that's not a good way to go, all it takes it a different story from the Polish couple as to who was driving and how it all happened during the claim process for the potential fraud to show, and to claim he was driving when he wasn't is fraud.

Ah yes my mistake, as soon as someone commits a crime from outside The Empire, the Thin Blue Line has no jurisdiction and everyone always gets away scott free. Rolling Eyes

Fact is, the OP has a broken car and nothing to go on. The police are bound to uphold the law, and it's one of those laws to have valid insurance on a vehicle used on the road.

Is it really that much of a jump for you to understand?

Yes, your rose tinted view of the police ''service'' is quite difficult for me to understand. Have you tried reporting a crime in recent times? I have. It is extremely difficult to get plod to show any interest in anything that involves getting off their arses and leaving the comfort of the station.
Uphold the law? Rolling Eyes

Actually yes I have. Recently I was on my pushbike and was hit by the wing mirror of a car that did not stop. I caught the last three digits of the number plate and the make and colour of the car. Within 3 days they'd found the fat prick who was driving, gone to see him, presented him with my account of events, and asked for his story and called me to ask me to make a statement for prosecution. All with out me making any more effort than a phone call. I have to say I'm impressed with that.

A lot of it has to do with how you approach the subject. If you come across as dick they won't take your complaint seriously. I would like to put money on you yourself failing the attitude test at some point in the past which has coloured your judgement.

All of which isn't really helpful to the OP. But what I'm saying is that they've got nothing at the moment, and this is the only route to getting something.

Report them to the police and make a claim to get the car fixed.

Uninsured drivers are covered by The Motor Insurance Bureau. You should be able to do this through any personal injury claims solicitors, if you've got legal cover with your insurance then they'll put you in contact with some no win no fee solicitors but IMO you're better choosing them yourself, the insurance company get paid by whichever they send people to.

As said, you can still claim from the boyfriend's insurance (assuming he is insured in the UK) as the RTA says that the insurance company must provide third party cover no matter who is driving the car.

Ahh, thanks chaps, good to know that my Mrs can claim off the chaps insurance. Thumbs Up

The reason why she did not want to tell lies to her insurers is she doesn't want to commit fraud.

I will find out who she is with. Wink

EDIT:

Jon she is with 1st Central

Is that only when the vehicle is being driven with consent? I can't recall ever hearing that people in incidents or being killed by stolen cars can claim off the insurance of the car's owner. It is the case in some countries including certain states in America where the vehicle is insured regardless of driver so actually includes thieves, but then it doesn't affect your premium really as you're always insuring anyone to drive the car so it's always the same. In the UK you would become uninsurable as I can't imagine you have to declare a £1million pound claim for killing someone because the guy who stole your car ran someone over.

I'm pretty sure the insurance company still pays out on your behalf if someone steals your car and crashes it. What would be more interesting is if your car wasn't insured (parked off the road) and it was stolen and involved in a crash. Who pays then?

I thought you had intelligence about you.
Are you for real? some foreign retard drives a car un-insured, doesn't bother to drive with due care and attention but it's ok for her toget away with that?

If it was you, I presume you'd be fine letting a foreignr off after damaging your car/bike, yeah?

Rolling Eyes shame he didn't get out the right seat, eh..
Plus, the OP is commiting fraud/lying then should he go along with saying the fella was driving - assuming the couple won't open their mouths and have it all back-fire? Thumbs Down
