OK, I need some advise on this one, let me send you to two photo's of the location before anyone answers my question !

https://www.cmirrors.pwp.blueyonder.co.uk/parking/1.jpg

https://www.cmirrors.pwp.blueyonder.co.uk/parking/2.jpg

As you can see from these two pictures, the area I parked my motorcycle was next to the single upturned u bar thats embedded in the ground and fenced off from the general public, the motorcycle was not parked on the road, nor was it on the footpath (footway parking is on the ticket). The bike was not parked on the service hatches to the Telecoms boxes in the ground either !

Now I want to know if the Warden was correct to issue a ticket for parking here ?

Let me point out a few things as well, there was no sign saying no parking for motorcycles or cycles even though this single cycle parking bar is in the ground. Not only that, I was gone just two minutes !

The area is also fenced off, so the general public have to walk around it, so here it's not an obstruction to pedestrians.

Sensible comments / options welcome.

Those things are for pushbikes generally. And yes they can give you a ticket there, and the amount of time you were gone for makes no difference.

Where abouts is this?

Hmm, seems to be a bit harsh.

It may be worth appealing.

Hmmm, don't see how they can make that one stick. That is a designated cycle parking area, a motobike is taxed as a bicycle, ergo you can park there.

Then again, I've never had a parking ticket, so possibly not the best advice! Confused Maybe the warden was just trying to get what he/she can?

I reckon it's pavement and therefore you're screwed, but it's worth a go at an appeal, since all that'll happen is they'll stew on it for a few months then hit you with the reduced fine anyway. Never know, you might get away with it.

18 and counting. Plus 2 on my scooter on the same day, which didn't amuse me much at the time.

OK guys and girls, want some info on parking your motorcycle on the pavement..... visit the link below

https://www.parkingticket.co.uk/sh.html

And just to quote a section from this page / site

Quote:
To avoid being ticketed in London, particularly in Camden and Westminster, bikes need to be parked in an area that is either fenced or has some form of barrier that prevents pedestrians from having casual access.

Where the footway begins and ends is a matter of highway and road law, not parking law. As we have said, each case depends on its own facts. The only safe course is not to park on a given area unless it is quite clear that it is not part of the footway. I would be wary of parking anywhere that the public, using the footway, were not physically prevented from walking over, by a barrier of some kind such as a wall or fence.

And the following is from this site

https://www.motorcycleparking.com

Quote:

In areas where barriers exist or which have not been a right of way for pedestrians, then motorcycles should be outside the long arm of the council parking wardens

So, do I have a case that I can win ? Should the ticket have been issued ?

Ian, I think she answered your question. It's a cycle bay, read your tax disc, says "Bicycle" on it. They wrote the law, not us Very Happy

OK, I've now handed in all the info I posted here and photo's of the location to Sutton Council with a letter of appeal, I now have to wait 7 - 14 days for them to write back to me on it.

I'll keep everyone posted on the outcome.

They are always a bit cagey about the fact it says 'bicycle' on our tax disk, if you read the highway code (yawn) it does always refer to pushbikes as 'non mototrised pedal cycles' (or something like that) and not 'bicycles'. So for some bizarre reason, I think, in the eyes of our stupid law' you still can't get away with doing things in a designated 'pedal cycle' area eg parking and cycle lanes etc etc..
