OK, IT'S A LONG STORY, BUT I'LL TRY TO KEEP IT AS SHORT AS POSSIBLE!

My boyfriend bought a brand new bike from a local shop just over two years ago.

Didn't really worry about the logbook untill Feb 2009 when the bike was due to be taxed, then, we had a mad flap and panic as we realised we had never recieved the logbook.

We went back to the shop where the bike was bought and was told the bike had been registered to my boyfriend (Shaun) and the shop owner would send for a new logbook on his behalf but wanted £28 to do it!

This wound me up as I thought it was a con to get more money out of us, so we went home and rang the DVLA.

The DVLA said the bike was NOT registered in Shauns name and he would have to apply for a logbook, which could take up to 6months to get. In the meantime he was not supposed to use the bike.

So this was a year ago. The DVLA refuse to give us any information on who the registered keeper of the bike is.
Does anyone have any ideas on how we can trace the registered keeper?

Just go to the post office and get a form to get a new logbook. It does cost about £25 if you don't have the new keepers slip.

Yes, sending for the logbook directly is the only option I suppose, but shouldn't we have already had the logbook as we have paid for it once already when we bought the bike?
When we rang the DVLA, they said it wasn't registered to Shaun, and was infact registered to someone else, and it would take them upto 6 months to sort this out.
And then it would also appear that Shaun would be the second keeper, not the only keeper (as he bought it brand new).
Can we make the shop rectify their mistake, and at their expense?

Oh, the shop owner registered it and taxed it for Shaun, it has been stood in the garage since the tax ran out in Feb 2009.

The V5 is for the ‘registered keeper’. If someone had stolen the bike, they should have the v5 and you could not contest this if your claim was they stole the bike.
At this point however, you could ask the police to investigate, for which they should be able to get details from the DVLA.

The legal ‘owner’ is different I believe – the person that has paid for it, etc.

Anyway, I think first case I would go and make a big fuss at the bike shop if they are still trading.
I would be tempted to hint at contacting MCN, trading standards etc.

As long as you have proof of payment (a receipt or even a bank statement showing the payment) then the Sale of Goods Act will establish you as the legal owner i believe so no worries there, and as others have said if you return to the shop and start making noises about trading standards they should sort it for you.
Of course if they don't then your local trading standards office will pleased to help you

I reckon the shop registered the bike to themselves, and were then gonna send the v5 to afterwards. I bought a chinese bike brand new about a year and a half ago and found out after I received the v5 that I was the second owner and the shop was the first registered keeper??? I never queried it?

As paddlesat16 said, are you sure the bike wasn't pre-registered? Did it have a registration plate on before your man bought it?

It may be the case that the shop was the first owner and was going to sign it over to you. However, they lost the V5, kept quiet, and never applied for a new one.

They saved themselves £20odd, and you guys didn't realise until now... When you asked them about it, they realised they'd have to come up with the goods, hence asking YOU for the money so that THEY could apply for the new V5.

Either way, pressure the shop. Call their bluff, and say you know they had registered it previously, and they never informed the DVLA of a new owner! If they don't act, remind them you have proof of purchase, then follow as has been stated with Sale of Goods Act/Trading Standards.

OR; Offer to do a speed test past some 'safety' cameras, and see where the NIP ends up...
