Actually its a little bit more than that.
In the first six months the fault is deemed to have been there from purchase unless the dealer can prove otherwise. After 6 months the onus is on the consumer to prove the the fault was there at time of purchase.
So in theory if something fails due to a manufacturing fault you can claim 2,3,4,5,6....years down the line.
Been around a few years now, and as said these rights cannot be taken away from you, hence why so many dealers pretend to be private sellers. ____________________ Fallen Angel "Nae sniffing my seat now!!!!! "

Quote from bike magazine:
"Under new consumer law if something goes wrong with your secondhand bike in the first six months, the dealer has to fix it unless he can prove the fault was down to you and not an inherent problem with the machine. Any warranty is on top, and cannot be instead of this legal right". Just thought you would like to know. Would have saved some people I know a lot of money if they had known. |
Much good as it does you.
Knowing this and thus feeling safe, i bought my current ride from a dealer and have had to do a ridiculous amount of repairwork since i've had it, despite trying to get the dealer to sort the problems (things like head bearings, chain and sprocket, fork seals etc). I went as far as writing letters via recorded delivery, but ended up just giving up and taking it on the chin in parts and labour after being fobbed off repeatedly despite letters and phone calls.
There's a hell of a lot of scope, in that consumer direct essentially told me that i can only really make them pay out for parts that could not have expected to have worn out. The bike was 14 years old when i purchased it, so basically that was nothing at all (despite the advert making out it was near-immaculate and the phone call to them in which i asked many questions and was lied to, because i failed to record it, thinking it wasn't necessary). Apparently they can even get away with putting "as new" for a front tyre i had to change 1000 miles (due to excessive wear) after purchase too. It was a farce.
I didn't take it to court as i was advised it could go either way, but that was the only way i was ever going to get the goods out of that lying firm i bought the "excellent condition, no problems" bike from. So beware. ____________________ -- Ingah |

Which are all comsumables, and as such once you have riden away from the dealers. You are them wearing them out. So don't expect a dealer to simply say OK and replace them.... You will have to pay something towards them. Even if you pay for the parts and they stump up the labour its a winner for you.

Not all of them:
Within 6 months or less:
Coolant leak.
Chain and sprockets.
Front tyre (1000 miles on the "as new" tyres - i.e. 2 months)
Rear tyre (losing pressure, slow puncture - remember this was within 1000 miles).
Head bearings (within days of purchase, despite a 2 week old MOT).
Front fork seals (within a month).
Ignition switch.
Speedo drive unit.
Speedo cable (happens i guess).
Front brake hose.
Left mirror, coming back from the purchase (kept falling down at motorway speeds, nothing could be done to hold it in place, even tape).
Fuel filler cap. Half the key was stuck in the cap (at the time of purchase, where i wasn't told of course).
Rear brake drum randomly seized a few months later.
That's all just what i can remember off-hand, within 6 months (loads more happened after too). Some of those, a couple at least, i can understand (e.g. cables and hoses), but some of them, especially in light of what i was told, was outright dishonest of them not to put right.
My point, was that these outfits often try to disregard the law and cut too many corners, and so indeed, never buy until you KNOW what it is you're buying.
Dealer had offered and a parts only warranty, but (even after sending head bearings etc back) all i ever got out of them was some cheap and nasty 3rd party fork seals, and some fork oil. And fobbed off. If i'd recorded the original phone conversation, where i was specifically asking about things like chain and sprockets, i would've had a fair wod of cash out of them in small claims court (as i'm aware they aren't allowed to lie outright like they did). ____________________ -- Ingah |
