How close do you have to be to get caught, or is it as soon as it can see you ?

A retired policeman told me that you were allowed to be 10% +3 but Im not sure how true that is.

I used to believe that 10% +2mph was the 'safe' zone, but it turns out, it is discretionary. After police were doing a sting in a nearby residential area, there were many 'offenders' turning up to the speeding class to avoid penalty points - including one nurse that was 1mph over the limit. The policeman's response is that the 10%+2mph is discretionary and not a legal guideline.

I said it was discretionary, doesn't me to say according to your speedo, that we can all do 40 in a 30 and won't get pulled. Just because you did....it's discretionary... it's almost like a lotto.

I also didn't say that she was prosecuted. She paid to attend a 'speed class' in avonmouth, bristol.

ACPO guidelines are 10% +2 mph. However they are only guidelines. So in theory you can be done for being 1 mph over.

I'm the lowest over the limit I've heard of for getting an NIP (3 points £60)... 36mph in a 30zone. Got off scott free in court though

You don't understand what you're talking about.

The 10% plus 3mph is wrong.

ACPO (Association of Chief Police Officers) guidelines states that an allowance of 10% + 2mph is given.

That is the lower limit at which prosecution happens.

Therefore
70mph = 70+10%+1mph = 78mph = no action
70mph = 70+10%+2mph = 79mph = fine and points.

Apply to all other limits including national.

Hope that's clear.
The get out clause is of course that they're only guidelines. However, the theory is you can't have one using the guidelines and another ignoring them.

Actually, I did deviate from the truth a bit there, and I apologise. The first person who got probed at 33mph attended a speed awareness workshop for a 'first offence' in lieu of points and a £60 fine. At 33mph. The second one, it was 34 mph, same stretch of road, but he did get three points and a fine. No, I haven't got the paperwork (yawn) and all, but it has happened, albeit at 1mph more than I said. Funny thing was my mate (2nd one) told me he thought he was caught at 39mph, so expected it.

34 in a 30 was enough to get me, I took the SAC at £60 and no points.

but speeding is an absolute offence, you either are or you aren't.

My cousin was pulled at 31mph, he got a warning but no prosecution.
they made it quite clear they could have done him, and don't forget, it just takes the opinion of two officers that you were speeding, they do not need to record your speed with any device to have you.

I got done for 37 in a 30, which means a drivers awareness course & approx 70quid to pay for it. They catch you as soon as they see you, even if you slow down pretty damn sharpish you're probably still going to get caught, hope you weren't too far over!
