Old man reversed into my parked bike :(

Well went out to the post office, whilst in the queue turned arround to see an old man trying to pick my bike up, i ran out swearing realised he had reversed into it............

Got to the old man told him to to leave it alone.

His excuse "i couldn't see it", "it was parked too close"

My reasoning "its bright yellow, big MTX bike..." "it was parked perfectly fine away as i checked before going into the post office"

He then admitted to reversing into it and believes there is sod all damage!!!!!!! petrol and oil all over the floor, scrapes from pegs digging into the ground..........

So overall damage that i can see:

1) bent handle bars
2) front brake levers snapped off
3) front right mirrors off
4) rear right indis snapped off
5) foot begs bent

usual scuff marks as its been revered into and fell onto its right hand side......................


So i am not happy at all, got all the details, pictures and videos of the aftermath but unfortunately no witnesses, just people heared it and everyone said same "you can't miss seeing the bike its big enough / bright enough" and unfortunately no day time recoding CCTV Sad

So called my insurance (benets) and they have took down my notes etc and the other guys details.

Expecting a call from a garage later to collect the bike and inspect damage....

My insurance company has gone and said as i am third party, the garage will put all charges on the other guys insurance who reversed into my bike but i now need to check if i have legal protection on my policy. if i do then i am safe if its a write off. if i don't and the bikes a write off then i gotta contact the insurance of this guy my self :S

does this sound right? i have third party only insurance.

You might be better off just changing the significantly damaged bits yourself for minimal hassle, they all sound like bolt-on items.
£200 or so?
MX bike doesn't look so bad with a scuff here and there.
He might offer to pay some or all of the costs surely

Sounds weird..

I have had a few accidents when only Thrid party and since the accidents weren't my fault, my insurance company was always more than happy to help. Well they contract it out to Angel Assistance / Helphire

I was lucky in that I had a witness when my bike was reversed over, but even though it all went on their insurance I still had to fight to retain my no claims, even though I was at zero fault, and didn't make any claim on my insurance. You're lucky with TPO you won't have that hassle Smile

What insurance co is the old duffer with? If it's any of the biggies then generally speaking you'll be best off ringing them direct, telling them the circumstances that it's a definite non fault claim as he's hit your vehicle whilst parked etc - they'll then arrange for it to be collected by an approved repairer and give you a courtesy vehicle if necessary.

Your insurance co won't touch it as you're TP - best you'll get is the legal expenses option which just adds to everyone's costs and keeps poorly experienced solicitors in jobs.

9 times out of 10, a decent composite insurance co is going to opt for easy settlement which involves getting your bike in for repair at one of their garages.

The Angel Assistance bit is the Legal Expenses option that's bolted onto your policy at ~£20 cost up front. The truth is even if you didn't pay for it before the loss, you could pay for it now and have the "benefit" of it, but then the real truth is you could just pick your own solicitor to work on your behalf and not bother paying up front for it anyway.

Nah they'll probably try and claim your bike fell over onto the client's car as a way to worm out of it.

Yes. With TPO your insurer has no interest in the claim at all, beyond defending it if the other party tries to claim from you / them.

At best you might have legal cover, or more likely they will throw you to some ambulance chasers to claim for you (and add their fees onto the claim).

Personally if the damage you describe is all that is wrong then try and avoid insurance. Likely to be far faster if he coughs up the couple of hundred pounds it would cost to repair (assuming new parts), and probably cheaper for him as well.

I was with Ebike and have been hit twice and every time they have handled the claim for me and pushed it along. I have had always had the payout within a month too.

With MCE now so dreading having a crash. lol

I guess with no witnesses it would come down to the balance of probabilities. what is more likely, your bike fell over and this kind man was trying to help by picking it up, or he hit it while reversing.

For an old duffer - probably not. Step NCB back 2 years for a £250 claim he'll increase his premium by ~25% at most if he shops around a bit. Bearing in mind average old duffer premium is ~£130 it's £30 a year give or take for the next couple of years, spread over.

But otherwise agree, yes, if he's got some cash he doesn't mind parting with it would be easier that way round.

see i thought about just saying "well you can give me some cash to sort it out or i can go via insurance" but because my bike would not start at all for a good 10 to 15 mins and i didn't have the right tools i thought insurance will be best choice, its what i am paying so much for a year.

i know i can fix it myself in a day piss easy but its the money which i don't have Sad

the car that reversed into me hasn't got a single mark on it and he can't go saying "the bike fell on his car" as people saw the bike on its side begind his card but not the collision.

gues its just a waiting game now and see what this garage wants to do about picking my bike up etc.

Ring his insurance company first. I wouldn't let a garage take my bike anywhere without knowing I'm not getting stung for a bill for it later on

If the bike is rideable ride it.....don't incur excessive costs...

Get a quote for the parts and fitting from a Honda dealer......

Contact his insurance with the quote........

Offer to fit the parts yourself........

Say you may have to hire a bike in the meantime(to put a bit of time pressure on them)......

You should get a cheque within a few days......

Buy pattern parts from Wemoto etc........

I've done this twice now and insurance companies seem happier to shell out £200 quickly rather than fight and have to pay hire and labour charges.

Pocket a small profit........

just dont mention anything about witnesses at this stage... keep them guessing

Hi

Yes a dealer will charge to do a quote (and you probably need to get at least 2 done for insurance anyway).

As to excess, most policies have them. The amount varies. Some policies will even be cancelled in the event of a claim. This was the case with someone who pulled out on my step mother who had a new car which had come with several years insurance included in the price. There was no way he wanted to claim as the insurance was worth £5k at the very least to him.

ok some progress.................

basicly the guy who crashed into me ... his insurance is sending out an engineer in about 2 weeks time to come see my bike, price up the damage, go away and send me a cheque providing it all goes swimmingly.

this so far has all been stated as being done free of charge and if there are any charges it all comes out of the guy who reversed into me.

between now and then i will be doing my own pricing up of parts Smile

ok priced up new parts online, also going to call a few dealers see how much they will get it all for and get some receipts and keep them for insurance purposes.

can tell you now its not looking cheap.

TBH from all the damage you listed it wouldn't cost more than 100 quid.


I would've done it outside of insurance. Spoken to the culprit. Asked if he wanted to do it outside of insurance as it'd be cheaper for him and will be a lot less hassle to you!

Not cheap?

1) bent handle bars - 20 quid
2) front brake levers snapped off - 5 quid
3) front right mirrors off - 10-20 quid
4) rear right indis snapped off - 10 quid
5) foot begs bent - 10-20 quid.

Fair point.

As an aside, I did knock over a bike in a car park a few years back (totally my fault). Left a note but then managed to grab the guy later on. He got some prices and I paid him cash. I would certainly pay up £300 or so rather than go anywhere near an insurance claim.

there is a possibility my front wheel has a slight buckle and my yokes might be damaged, i am going to give it a closer inspection tomorrow for sure.

your prices are close to my findings but then need to add postage on top and its mainly the handle bars, possibility of yokes and wheel that bump the price higher.
