Hi guys,

I had an accident in February that wasn't my fault, and my bike was taken away from me at the scene. Was only a CBR 125, but it's been in storage since. I couldn't walk for a month and have only just got the money through from the insurance for the bike (£2200).

This storage place is in Manchester, it's a third party private company I think, and I called them up today because I have money to pay for the release of the bike and they are saying that there are £1400+ of storage charges! I also have to pay this by 12pm tomorrow or the bike gets crushed on Monday because the insurers don't want it.

Do I have to pay the storage charges, just to get the bits of bike back? It's almost £1500, which is crazy! My solicitor says that I might be able to claim this back from the other guys insurance, but it's not a definite.

What do I do? Do I pay it and get the bike out of there? Do I let it be scrapped, contest it, what?! Any advice would be much appreciated!

Hi

I presume the insurance company are liable for the storage costs anyway and should have settled that as part of the claim. I would ring the insurer and find out if they have paid / are paying the storage change.

You have been paid out to compensate you for the bike, and so strictly speaking I am not sure it is yours.

Thanks Keith,

Just called the insurers and they said it's only the solicitor who can help me with that. My solicitor says that my only real option is for me to pay the charge and then they'll try and recover that back from the other insurers, but it's not a definite.

It's just the "it's not a definite" that gets me.. This money is supposed to be paying for my bike, not for the flippin storage of it's parts! Confused If the other insurers wont pay up for it for some reason then basically I'm paying for half of my accident.

Edit: I had TPF&T on it.

So your bike was worth £4,400?

You've been paid out, so now you have the option of 'buying' your bike back from the storage company (probably not worth it), or keeping the cash.

If you have been paid out for the accident then the bike belongs to the insurance company unless they have sold it back to you

what "parts" are you referring to?

wheels etc or a mars bar stored under the seat given to you by the Queen?

the wheels, i'd say you have to pay for as it belongs to the insurance company
the mars bar, imo is your property and you should have had the right to remove it as its not part of the bike

But now I have to pay £1400 storage charges.

The insurers don't want the bike, so either I pay the storage charges before 12 tomorrow and pick up the bike, or it gets scrapped on Monday and I assume the storage company will still want all that money for storing it.

So yeah, I've been paid out for the bike, but not the storage charges.

EDIT: Parts I mean the bike is whole, but the front fairing is hanging off, broken lights and electronics and bent levers and handlebars. Possibly bent forks.

Hi

The insurer has paid for your bike (and presumeably enough to cover its replacement with the remains just disposed of by the insurer), but the storage should have been part of the claim.

I would suspect the storage company will want paying for the £1500 and don't care who pays. But suspect that you are liable for it whether you have the bike back or not (ie, you owe them £1500 now whether you collect the bike or not). The storage cost should have been part of the claim (and I really hope that the amount you have been paid isn't part of an agreed full and final payout). In theory it is a cost you have been hit with and should be covered by the liable party / their insurance company.

If you are tpft then your own insurer has no interest in your losses from the claim, hence why they just tell you to speak to the solicitor.

You have been paided out for the bike which is no longer yours it is now the insurance companys who are liable for the charges and it is there choice to what happens to it not you.

And due to the storage charges they will allow it to be broken/sold by the storage company.

It should have been part of the insurance deal/payout, I remember my first accident, which was a write off, I got the payout on TPF&T which included the defendant's insurance company paying the storage costs, which wasn't much as I pulled it out of storage as I wanted it back.

But none the less, you will need to get on top of that if you want your bike back, but it is not up to you for liability of that cost.

You're certain it's storage charges? When my car was written off I essentially had to deal with a third party company who I would have had to pay if I wanted it back.

If its the same deal with yours then you can just walk away with it, they'll sell it to a savage yard who'll try and pass it off as a bargain for about £150 less than a straight one.

100% it's storage charges. Even if the bike is scrapped on Monday by them, I'll still owe them 1.5k apparently.

you didnt ask for your bike to be stored, luckily my accident, someone pulled my bike to their garden.. but if the accident wasnt your fault, the other side is 100% liable for ALL costs incurred to you from the accident.

also, you wouldnt want a crash damaged cbr125 for £1500, you can buy a good nick on used for 1200...pointless considering buying it back.

If you need any harsh letters to solicitors, let me know..ive had 8 non fault accidents and managed to hammer them to give me every single thing ive paid for as i didnt have use of my bike... Thumbs Up

True, unless they have already accepted a settlement including the bike and storage for a lessor amount then the other persons insurance has discharged its liabilities.
