Hello all,

Just got back from a late evening ride around Gloucester. There are loads of Police cars along the A38 between Tewkesbury and Gloucester tonight, and like a good citizen I was alerting fellow motorbikers with a wave of my left hand - But I very nearly got caught out. I had my hand about an inch off the handlebars before I realised that I was about to wave to a Police Motorcycle. Not quite sure what I'd have said to him if I did wave Laughing

Hi Ralf, instead of just wafting your hand about, use the thumb down technique.

The only times I've slowed down and realised it's when it's eitehr another biker or on a biker route, al boxhill-buryhill or vice-versa.

When it's cagers and I'm on my own near my local roads I'm like? Huh? But I do tend to slow down.

Your right, you just gotta wave. Isnt there something in law thought about preventing a Police Officer from doing their job? Personally I think its preventing a crime...

Yep, since they took the speed camera out by Twigworth they tend to use vans. Have also seen them in cars with guns out of the window at the Gloucester end of the road.

Incidnetally, I cant find any example of UK case law where someone has been prosecuted for alerting drivers about a speed trap.

There was one not so long ago where a guy made a sign saying speed camera ahead, and he lost his license.

Do you recall what law was broken as I still cant find anything in UK law that says its illegal? Avon and Somerset Police have a live webchat with a real PC from 7pm - 8.30pm tonight and I've just submitted this question in advance...

"Hi there,
Could you please help me with a point of law. Is it illegal for a road user to alert another road user of a speed trap ahead ? If so, which law would apply and are you aware of any cases where drivers have been prosecuted ?
Many thanks"

I've just found out what was going on...from the Gloucestershire Constabulary website

I bet you lot are jealous that I live in such a low crime area that all this resource can be used to find 1 car with no insurance, 1 with a defect of some sort and 1 with red diesel

"Tuesday July 27, 2010

Yesterday evening, Monday July 26, police worked alongside a number of other agencies in an operation targeting criminals travelling through the county.

Operation Mantis ran from 5.30pm and saw police officers, special constables and officers from the roads policing unit and dog unit work working alongside colleagues from the DVLA, the Department for Work and Pensions, Customs and Excise and the Vehicle Inspectorate.

The operation made use of ANPR (Automated Number Plate Recognition) at a site on the A38 at Norton to target vehicles used in crime, such as for transporting stolen goods, as well as those driving without the required documents, under the influence of alcohol or drugs or whose vehicle is un-roadworthy.

72 vehicles were checked by Police during the operation, one of which was taken off the road for having no insurance and a second for being defective.

Vehicle Defect Rectification Scheme notices were issued to 12 drivers, requiring them to attend an MOT testing station to prove their vehicles have had the faults identified by officers corrected. A learner driver was issued with a fixed penalty notice for driving without ‘L’ plates.

Eight drivers will be required to produce their licenses, MOT and Insurance certificates at a Police station within seven days, or face prosecution.

The DVLA prosecuted 32 drivers for having no vehicle tax and one driver was given a £250 on the spot fine by Customs and Excise for the use of red diesel.

The Department of Work and Pensions are also carrying out follow up checks on five individuals as a result of the operation.

Inspector Paul Cruise said; “We are determined to ensure that the county’s roads are as safe as possible and that drivers are operating within the law.

“We hope this operation offers reassurance to law-abiding road users that we are committed to keeping them safe as well as reducing and preventing crime.

“We want a clear message to go out that those acting illegally will not be tolerated and we will do all we can to cause maximum disruption to your plans.”

not sure if this helps or not...

https://londonbikers.com/news/6266/lords-asked-to-rule-on-speed-trap-case

And this from Wikipedia about the AA...

"In 1910 in legal test case ('Betts -v- Stevens') involving an AA patrolman and a potentially speeding motorist the Chief Justice, Lord Alverston, ruled that were a patrolman signals to a speeding driver to slow down and thereby avoid a speed-trap then that person would have committed the offence of 'obstructing an officer in the course of his duty' under the Prevention of Crimes Amendment Act 1885.[2][3] Subsequently the organisation developed a coded warning system which was used until the 1960s whereby a patrolman would always salute the driver of a passing car which showed a visible AA Badge unless there was a speed trap nearby on the understanding that their officers could not be prosecuted for failing to salute.[4]"

grat article find Karma

my 2 pennys worth is that we shoudl all be encouraged to slow people down if they are speeding... surely this is what cameras are for? sos urely the police would love to have 30 million motorists keeping everybody aware of their speed. this is what cameras as assigned to do is it not? to keep people driving within the limits not catch them???? i wish they would just coe out with it and admit taht teh cameras are set up to make money and issue fines and not to prevent like they advertise...

such a f****** farse
