For the speeding, 61 in a 30.

I was debating whether to turn up at all listening to different people telling me don't bother etc. I decided to go, suited and booted, arrived at 9am even though the court didn't start until 10am.

The magistrates saw me as well waiting at about 9.10am. I went in and the clerk said, "As you've already pleaded guilty by post, today is a chance for you to explain yourself and any mitigating circumstances, can you tell the magistrates now.."

I'd already sent this in but I basically recited this out loud to them:-

Firstly, can I just apologise for even having this case in front of you today, I should not have been speeding in the first place and would just like to apologise for wasting the courts valuable time. I do not wish to offer a set of excuses as to why I was speeding but would like to explain the circumstances on the day and the repercussions it would have if I were to be banned or have my license revoked.

On the day in question, I was doing a delivery for my mother and sisters business (they’re diet consultants, self employed). I help out where I can with delivering orders to clients in the surrounding areas of Wigan, as they see up to 10 clients a day at their home addresses. It was a particularly large order worth £300 but I had a second order that had to be delivered first as the lady was going on holiday. I left my house on my Kawasaki motorcycle to get to the first delivery address, the road I was caught speeding on had a row of houses on the right and I was travelling down the left which has fields next to it. The bike itself is a very powerful sports bike, I held the throttle down for no more than 3 seconds in a rush and looked down to see my speed and realised how fast I was going so eased off the throttle. At this point as I was slowing down, I noticed the camera van in my rear view mirror.
I have never sped like this before and have never received points for a speeding offence in my life. I passed my full motorcycle license in July 2009 and the bike was garaged for 6 months over the exceptionally harsh winter. I had only 4 months riding experience on this machine and I can only put it down to lack of experience riding a powerful motorcycle combined with being in a rush. I have since sold the motorcycle and bought another one less than half as powerful to get used to riding and not have all the power there until I’m an experienced road rider.

My mum and sisters diet business is the bread and butter income of our family and pays most of the bills and mortgage on our family home. My dad has been suffering with depression for the past year and is unable to work and my mum is now taking 6 months off work due to a hip operation due in the next month. We also have a family owned cafe which is run by my brother and sister in Wigan, which I also help out with food deliveries when needed.

If I were to be banned or have my license revoked, this would have a detrimental effect on my family, our businesses and our houses. I’m also a self employed web designer and although I don’t need my motorcycle for work very often, my help in the family businesses brings in a much needed income which helps pay some of the staff wages at our cafe.

I’m only telling the court this to help give an insight into the immense pressure we’re under as a family to keep our businesses afloat and pay the mortgage when the next 6 months of our lives will be some of the hardest yet financially and mentally.

I know that speeding is an offence and I also understand the seriousness of what I have done and I can only apologise sincerely for my actions and the offence I committed. I ask that the court takes this into consideration and understands that a driving ban or license revoke would have devastating consequences for my family.


They listened to that then asked me a few questions. One was about selling the bike and buying one less than half as powerful, the magistrate asking the questions asked me what kind of bike, what BHP it had and top speed etc. He must of been a biker the questions he was asking.

They fucked off for 20 mins to decide what to do, when they came back, they said, "We're impressed with the fact that you turned up, you're suitably dressed, we saw you arrived early and also the fact about buying a less powerful bike".

They banned me for 28 days, £250 fine and no points.

So in summary, it does make a massive difference turning up suited and explaining yourself, if I hadn't they would of definitely banned me for longer than that and a more harsh sentence.

They gave me my license back there and then and said you can continue riding on 9th September.

Just thought this might be useful to anyone who may be getting done for speeding, those mitigating circumstances showed that it wouldn't really have had any effect on me personally but other people and family members which definitely helped. They asked questions about would I be getting more invovled whilst my mum was having a hip operation and time off.

At the end as well, the main magistrate said, "One more thing, I assume you know other bikers too, can you just pass the message onto them that this is a serious offence and..." forgot what he said now Laughing

did you have business insurance for doing the deliveries, surprised they didn't do you for no insurance too (if you didn't that is)

I was expecting to get spanked. I mentioned about having my license revoked and they asked me what would be better. I told them it could take a few months to re-take my tests with all the waiting around etc and a short ban would be better.

One of G's comments was playing on my mind from a topic I made a while back about this, he said he had travelled miles, taken the day off work, turned up suited and got spanked worse than he thought and wondered whether it was because he actually did turn up, like wasting their time.

Glad I did go though, also looking around the waiting areas, all the other young lads were wearing trackys and hoodys, so it must of been a refreshing change.

They say, it's always "summat to ate" in Wigan. They have it sussed, clients come to them to lose weight, they direct them to the shop and make them fat again, repeat business.

Well written, if a bit creepy, but hey it worked!

I sepnt £60 on a solicitor in 1999 and was banned for 28 days with a £300 fine for 127 in a 70.

If its anything other than a straight 3 points for speeding ALWAYS turn up and tell them what they want to hear in a well written statement. Much like Jay did here.

Mate did the same, 120 on the motorway, turned up pleaded guilty and gave a sob story, one leg, 2 kids, own business etc and got out with £300 fine and 14 day ban.

Did you forget to answer the one about having insurance to cover you for business use?

I had almost exactly the same,

66 in a 40, turned up to court, in a suit (although i rode in so looked a bit scruffy), just looked as if held some respect for authority, in the end they gave me a 30 day disqualification, slightly less of a fine than you (including "victim surcharge" ) but no points.

As i had kind of resigned myself to possibly 6 points, putting me on 9, after that bad month of not legally being allowed on the bike its worked out fine, as now i only have 3 from an old gatso, that runs out in about a year or so..

Use the month to give the bike a clean, sort out any odd jobs you been meaning to do, and dont get caught next time Razz

I forgot about this, because I'm in my 2 years probation period, I'm sure I read somewhere that if you're banned you're no longer in the 2 year thingy whe it's up? or is that license revoked?

Chances are they'd already decided anyway. I got caught for 69MPH in a 40, pleaded guilty by post, then a few days before the court date they sent a letter saying its been cancelled as they are looking to ban me. At that stage I lost all respect for the legal system.

Got a new date that I had to turn up for, explained the situation (basically being caught less than 20mitres outside of a 70 zone which joins a 40zone on a slight corner) but they didnt care and gave me 6pts and £250 fine. Pointless evening mentioning it.

They were more concerned with getting their money tbh, had loads of graphs on the waiting area about how good they are at collecting money from 'criminals' like myself. I was getting close to telling them to do what they have to to get the cash because I dont have it when good old Mumsie stepped up and paid it and thankfully she has a better repayment scheme Smile

Btw, I turned up in a t-shirt and jeans. If how you dress makes a difference then it just shows how screwed up the justice system is.

I agree with that last comment but it applies to all kinds of things. Like if you go for a job interview, they say don't shave your head, why not? Surely they're capable of looking past a shaved head?

Like my mate, he went for an interview with a shaved head and the guy mentioned it afterwards, said it's not a good thing and he shouldn't of done it. Yet, once they say hello and get talking to the guy, they realise he has every qualification needed, plus more and two PHDs.

That's the kind of thing that should matter, not physical appearance, it's bullshit and insane but what can you do apart from try and conform.

That aside, I just phoned my insurance company and told them I have been banned, they phoned the broker or whatever it is and asked them and they said they will no longer cover me because of this. That's not a problem but they're saying I have to pay a cancellation fee of £75. Technically, I didn't cancel the policy, they've decided they don't want to insure me, you think there is any way around this?

Sure, she might see the 'real you', but you might also lose a good change to see the 'real you' because first impressions definitely do count!

To an extent I agree, but the other way of looking at it (at least with dressing up for court) is that you are at least making an effort and don't regard the whole system with contempt.

I am more dubious about the way that they seem to reward those who are prepared tell lies (saying that it was a momentary lapse of judgement and that they won't do it again, etc) with a reduced penalty.

I got caught doing 60 in a 30 and got £250 fine and 6 points, no ban. I'm self employed so that might've been a factor.
