hi all,
i suppose my question is : does an insurance company have to inform you that your policy is cancelled?
i would have thought so!
heres the facts : i took out a fully comp policy for bike A, then a couple of months later added another bike (for a fee) of same capacity, with same excess etc.
i sold vehicle A to a polish guy who was going to break it up.
i never informed the insurance company (my bad, i know)
i kept vehicle B, in the shed & never took it out.
last week or so i've been moving stuff to my new lock up & decided to put vehicle B back on the road (its still taxed & motd, in fact its done virtually zero miles since mot) so put it all back together & spent yesterday test riding it. (just up & down my street, but still on public roads).
this morning i was looking for my insurance policy papers & decided to go onto ASKMID because i couldnt find them, & was surprised to see vehicle B was not insured!
i then went onto the insurance co.'s website & was greeted with "YOUR POLICY IS CANCELLED"
i never got any letter/email or refund!
i was planning on using the bike this weekend (vehicle B) but now cant as its not insured! (& cant affod a new policy just now) so im bikeless!
thing is i passed a couple of police cars yesterday & was quite confident, that if stopped, i was insured!
glad they didnt pull me!
whats my rights?
should they have informed me?
should they have refunded me,something, anything?
should vehicle B still be insured?
i sold vehicle A about 3 or 4 months ago, so if they cancelled it then, that meant policy for vehicle A was running for approx 6 months & vehicle B only 3 months.
i feel i have been let down, & this is not the 1st time i've been shafted by insurance companies!
opinions? advice?

yup, paid in full when i took the original policy out, & then called a couple of months later & added the other bike, again paid in full.
i presume they cancelled it because the polish guy i sold bike A to, sold it on?
i seen it advertised again, 3 weeks after i sold it (needing a new top end,lol)
so im presuming that the new owner insured it & my insurance company got wind of this?
afaik, you cant have 2 policies on 1 bike, so the original policy is cancelled. (thats what i hear anyway)
& its a bloody internet company, no help-line till mon. & their "contact us" thing doesnt work!

WARNING! ANOTHER LONG POST
hi all,
just thought i'd update this....if anyones interested,
ok, i finally got in touch with the insurance company. (internet based so you have to email them or pay a pound a minute to call them during the week)
heres the outline:
bought the original policy 18/01/10 & paid in full (for an aprilia rs125)
got insurance docs 24/01/10 which stated i need to send in copies of my licence, which i did on same day.
thought no more about it & rid the bike.
called them the following week,02/02/10, as i had bought another bike & because it was of same value & capacty (cagiva mito) they just added it to the original policy for something like 50 quid.again i paid in full.
during the call the woman said they hadnt received my licence yet (after taking my payment) so i agreed to send them in again.
sent them off AGAIN, 06/02/10 recorded delivery with po guaranteeing delivery by 10/02/10.
so i owned the bikes for a few months but tbh rarely used them (i always have around 5 or 6 bikes at any 1 time).
sold the rs in june to a polish guy who said he wanted it for parts. (but a few weeks later saw it re-advertised)
the mito was kept in the shed since june.
but decided to put the mito back on the road & probably sell it. so took it for a few test runs last week.
checked ASKMID the other day & discovered neither bikes is on the database, so i decided not to take the chance & not ride it any more, & contacted ins. co. (& posted in here)
heres the reply i got : insurance co. state they had to receive my docs by 10/02/2010 or policy would be cancelled.
they state they received my docs 11/02/10 but this was too late because once a policy is cancelled it cant be reversed.
they state they wrote to me recorded delivery. (a card was left but i was receiving lots of stuff from ebay at the time so ignored it, expecting it to be re-delivered, as card doesnt state who its from).
they also state they emailed me 24/02/10 : i received no contact since 02/02/10.
so they have had my money sonce jan/feb, not given me any refuns etc.(& earned interst on my money)
& now they state that their conditions state that if they dont receive your docs within the timeframe, policy is cancelled incurring a £75 admin fee!!!!
so at any time i could have been pulled & got banned (likely as i have a previous IN10 conviction) or got 6 points.
i have raised a complaint with the company concerned & i am awaiting a resolution before contacting ombudsman.
whats the general opinion?
am i at fault?
or do you think, as i do, a cuortesy call would have been more appropriate?
& at least a partial refund sent out by cheque, back in Feb?
do you think the date they say they received my docs, a tad coincidental/suspicious? (the day after cut off date,hmmmmm)
opinions plz.

If you just said "I've sold the RS125" then they probably have every right (in their own moronic way) to cancel the policy. If you instructed them that you still have the Mito but you want the RS removed from the policy then that is very different. |

thats the thing, i told them nothing!
the bike was supposedly being broken for parts & i was keeping the mito so didnt tell them anything.
not in any effort to defraud. i wasnt after a refund, nor was i after NCB.
they cancelled the policy because they say my licence got to them 1 day late. (which i knew nothing about) not because i sold the rs.
i was under the impression, that if they found out i had sold it, they would be be in touch (i thought they would find out somehow, if new owner took a policy out? maybe....)
I realise i should have told them when i sold the rs, but with moving up & down to/from Scotland/Essex it slipped my mind.
i thought that the policy would still cover the mito regardless.
however this seems to be irrelevant in this case, as they cancelled it in Feb.
at the very least i will lose £75.00 in admin fees & the £50 i paid to add the mito. (if they class that as a seperate policy, as its £75 for each policy!)
i think i should be entitled to the full initial amount paid AND the additional £50 with no admin fee.(who charges £75 for cancellation,ffs!)
or even the £50.00 for the mito & original amount paid minus £75.00, but this seems harsh, when a courtesy call would have prevented this situation.seems to be another case of taking your money & forgetting about you...the customer.. seems to be the way now.
they dont realise they have a fight on their hands & this is what i used to do for a living. (i was a civil servant involved in legal disputes)

Which company is this ?
Were your contact email details correct with them ? Did you check your spam folder.
Why did you not simply scan and email the licence to them.
Your real complaint lies with the post office. Did you check the online section to make sure it got delivered on time.....
If you read the Recorded delivery card. It states they will not try to redeliver, you have to go and collect..... It never states who its from....
Now this is where the great case against the DVLA and proof of postage falls down.
The company can use exactly the same arguement on non recieved docs
TBH, how hard would have it have been for you to check to ensure that they have recived everything they should. Given that you knew that if not recived in time they would cancel the policy. ____________________ Just because my bike was A DIVVY, does not mean i am...... |

well to be fair, i did send my docs, twice!
it does state in the insurance paperwork, they need the copies within a certain time or the policy will be cancelled with a fee of £75.00 being charged for failure to do so.
i asked if i could fax them but they said to post them, so 2nd time i sent them recorded delivery/signed for.
they definately never emailed me, as i keep all this type of email in my kept folder.(& i check my junk folder regularly)
the only emails i had were junk "recommend a friend" stuff & the like.
they never phoned me, despite having my number.(if they did, no message was left)
i think the important thing is they never sent any refund.
they were quite happy to pocket the cash.
iooi, you mention the case against dvla, surely this is the same thing, i posted off the docs, twice.
& i wasnt about to dial their 090 number & be charged £1.50 a minute to check.
perhaps i could have emailed them.........
i think imade every effort, i dont think they did.
i remember the card, but i was expecting loads of parcels & stuff so reckoned if it was important it would be re-delivered, i never thought it was from the insurance co.
surely they should make every effort to inform me of non-receipt AND make every effort to at least partially refund me?
if i had got a cheque in the post, i would have realised something was wrong.
or if i had been pulled by the police.
oh well, at least i didnt get pulled or have an accident or have the bike nicked!
& i should get some sort of cash back, which i will use for a further years insurance on the mito or another bike, but not with ebike,lol

Did you read the card? It's got instructions for what to do if you want your item redelivered.
The timing of that failed delivery being returned to them fits roughly with when your policy got cancelled. Have you got copies of the letter and e-mail that they sent? |

i did read the card but the sorting office closes at 6, i dont get home till after this so figured if it was important enough to send recorded delivery, it was important enough for them to write again/email me or call me. (none of which happened) so i didnt collect it from the sorting office. iirc, there was no option for re-delivery, but i might be wrong.
i think i actually still have the card,lol or at least i did until very recently. (bearing in mind i didnt know who it was from, it could have been one of many debt letters,lol)
hindsight is great, as i now kow that card means they wrote to me,but i didnt know this until a couple of days ago.
as for the docs i sent them, i paid for it to be delivered by, i think 10am or 1300 on 10/02/2010, i remember cos it cost me about a fiver!
i'll just need to see what their complaints procedure throws up,

they may well have written to me, but i was not aware of this.

a bigger concern is why they have held onto my money for 6 months?
the card could have been from anyone, as i had bought a few things from ebay, some of which were sent recorded delivery.
my records are are filed in date order & i have a spotless credit record (i have to) but at that time was involved in a dispute (which i won & received an ex gratia payment of £250 for "distress") with a company over a £35 "debt" which i didnt owe. & suspected the card was another letter from their debt collecton agency,
the way i see it i, i cant lose anything by raising the complaint.
their conditions state they should refund me minus the admin fee.
its this fee im challenging,& the length of time taken to refund.
either way i will get a refund of some sort,

Have you got the proof of posting? That would answer lots of questions as you seem to be very unsure of the details. If you haven't got the proof of posting or the proof of delivery then there was no point in sending your documents by recorded or special delivery.

It does have options on the card for redelivery. Your arguments don't make sense, you decided not to get the letter or to arrange for it to be redelivered, if you can't be arsed to get your post then that's 100% your fault and 0% the insurance companies fault.
How many other missed deliveries have you ignored?

I don't know. There are probably details in the letter and email that you've ignored. That's why I asked if you've got copies of them, if you call them up and ask them to email you copies then you'll be in a slightly better position cos with copies of the letter & email.

yes, i have proof of posting, from the second occasion i sent docs.wasnt too sure of the details as it was 6 or 7 months ago, but have now dug them out & it was sent by Special Delivery.

nope, no option for delivery. only says collect within 14 days or it will be returned to sender.
card is slightly different from usual, as it doesnt say i can collect betwen 0900-1800.
it not a case of "cant be arsed" more a case of "why the f*ck should i?" whats wrong with the phone, 1st class mail (they sent the all important Insurance Certificate this way) or email?
How many other missed deliveries have you ignored?
umpteen, as im usually out at work, if its something im expecting, i will collect or get it delivered to office.

they "say" they emailed me, but its not in my inbox. & i ignored ONE letter.

i havnt ignored any email : i didnt get it, i save all that kind of stuff religously.
i havnt seen any letter yet, lol so i have no idea what they say. i have emailed 4 times. 3 times to a rep & once to their complaints dept.
original reply from them stated why they had cancelled it : not received my docs until11/02 but PO.clearly record fact that it was signed for 10/02/2010 @ 1129
2nd reply stated send the insurance cert back for a refund minus admin fee
last reply was advising me to use "correct complaint procedure"
which i wasnt aware of & have now instigated.
their complaints manager is"highly concerned at the issues i have raised"
mainly : they claim i took out the "added bike online" & claim no phone call too place : LIES (this is when i was advised that they didnt receive my original docs & said to send them in again.)
they say they emailed me : LIES
1 recorded delivery letter is not "every effort to contact me"
£75 fees is a sham when i complied with their conditions.
6 months interest gained on my premium.
they state they didnt receive my docuntil 11/02 when the post office have proof of delivery/asignature 10/02 : so more lies.
I was riding without insurance
they say they will not refund until they have their insurance cert. back.
i have now sent this to them.

If you thought it was ebay stuff being delivered, why would you ignore it?
because, it usually states on card, "wait x hours & call to collect or call the above number to arrange re-delivery"
f*cked if im travelling 3 miles in my own time to retreive a letter, from whom i dont know, what it contains : i dont know
i knew it wasnt anything i had bought as card clearly stated "LETTER"
i actually thought it was from some debt collector who was threatening me with a County Court hearing. (we dont have county courts here) & i had started legal proceedings against them which i won a refund, all costs, loss of earnings etc & an ex gratia payment.
& they had been advised to contact my solicitor, which they were ignoring,lol

replied today : FULL REFUND WILL BE ISSUED WHEN INSURANCE CERTIFICATE IS RECEIVED.
COMPLAINT TO BE INVESTIGATED
looks like i was right.

tbh, i didnt go on askmid with the intention of checking the rs or mito, in fact i was checking a completely different bike.(my mates)
but i used to check it quite often & hadnt done it since jan (when the rs WAS on it) & thought i'd run all my bikes through it, while i had it open, not expecting to get the big red NO,lol
glad i did, or the only time i would have found out, would be if i was stopped or involved in an accident.
