Sorry, not bike related so no gory pictures Laughing

Basically, I just had a bump on the A14 in my car. White van tried to push in front of me and everyone else and I didn't open the gap in front of me to let him in. He just pushed across anyway so I had to brake and swerve to avoid him and then was right behind him for a split second at which point he did the old brake test as he was annoyed with me and I couldn't stop (wet road, ABS going, shitty tyres).

Now obviously as I went into him it will be 100% my fault in a claim as there are no witnesses to his manouvere other than me and him as no one else stopped. The only proof of the fact he was braking hard is that the damage is far too low to have been caused if his van wasn't lifting at the back and besides, he can just say the car ahead braked or a dog ran out or whatever.

Thing is there was almost no damage to his van and however much of cock he was at first I think he actually started to realise that he had properly fucked me over and started to suggest he might not claim after all.

Now should I tell my insurance company my side of the story now in case he comes in with a claim (even fecking whiplash Rolling Eyes ) or should I keep quiet and hope he doesn't claim? If I speak to my insurance company but then he doesn't claim does it still affect my premium?

...and I realise this is all my fault for not braking in the first place to open a gap for him (although there was one behind me which he could have gone into).

You should still inform you insurance company, just in case they inform their insurance and start a claim against you. Thumbs Up

But if he doesn't claim does that mean I've now got an accident on my (otherwise) spotless driving record that I could have kept quiet? If he doesn't claim, the accident didn't exist in the eyes of the insurers.

He took photos of my car parked behind his van on the hard shoulder...just circumstantial but pretty damning along with the cracked bumper and grill on my car.

If you phone them but don't admit to been at fault, you are just notifying them that there may be a claim made against you. Thumbs Up

If they don't go through their insurance then nothing will happen.

I started a claim 18 months ago, but after a couple of days I called my insurance and cancelled the claim, I still have my no claims bonus Thumbs Up

Don't tell them that you were tailgating the car in front and a van squeezed into the gap and you started to tailgate him as well.
Just let them know you had a minor incident. Thumbs Up

I wasn't tailgating up to that point, the traffic slowed, we all closed up, van tried to cut in front of me, I didn't back away (as I'm an over aggressive idiot) he forced his way in (literally would have hit me if I didn't swerve and brake) then IMMEDIATELY did the old brake test, I didn't have time to open a gap.

Basically we were all queuing to take that exit, he barrelled down the wrong lane to get ahead before his way was blocked by a slower car so he tried to cut into the left lane.

Sorry to hear.

I know it wont help, but if you as you put it want to drive like an "aggressive idiot" the lesson is not to back down, had he hit you (which you avoided) I think you'd be in a much better position.

I wouldnt even bother telling the insurance. If he claims they'll find out soon enough anyway.

Hell, I had to get cut out a car once and the road was closed for hours - the council told me they were even going to claim for a tree surgeon to check the tree i hit, never told the insurance about that!

if you cant come to an agreement with the van guy, and he does claim just tell the insurance you hadnt got round to telling them yet, although its probably in the small print saying you "must notify within a certain time" I very much doubt that for something so samll you'll find anyone who the insurance companies have cancelled insurance for.

I never back away either. But we should...
exactly the same thing happened to me but I was lucky. (van undertakes, brakes hard, we slow down to 10mph in the third lane of a fucking motorway. new pants please)

Yep, certainly got me thinking about how aggressively I drive (nowhere near as aggressively as the other bloke though Laughing ).

I've now phoned the police to see if anyone called it in because thinking back through what it must have looked like to the car behind I reckon I'd have phoned it in as he would have looked fucking insane when he swerved at me a couple of times.

I reckon he might not claim now as well because at best he gets a few quid for a new bumper, at worst he gets done for dangerous driving if a witness does materialise.
