Somebody twated me on the bike today.

Filtering on the a13 and the guy in front gives a flash of indicator and turns the wheel at the same moment, smashes my foot and rips the foot peg of without being big headed I was a fucking hero keping it up. I smashed his rear light cluster. So my peg hits his rear light cluster I was going about 30mph. I have a witness biker behind who saw everything.

Now if it goes through insurance will it go my way? I have a witness but the damage is to the back of his car. Pics and paint diag later.

I'd get all you can from the witness and try to get a copy of his account yourself too, assuming the other driver doesn't have any witnesses to support his version it may go a long way.
I think though if you hit his rear they're likely to simply say you failed to keep adequate distance, though I appreciate the guy should have kept proper lookout.
I'd suggest speaking to rider support services asap, they've sorted my claims out well before and are much more procactive than your insurance firm will be.
Does he want to pursue a claim? If your foot's just bruised and the only damage is your footrest maybe you should call it quits with each other?
Maybe if it can be made to appear more as if he was crossing into your lane without looking that'd help but the filtering bit I think kind of sticks you in legal limbo.

Well, tbh if he was filtering, which is legal.. and was within the speed limit then it all points to the driver not checking his left/right mirror, probably just checked his centre one.

I'd say you will win, purely because the driver failed to notice you, you noticed his indicator and within a second he moved. You had no option to slam on the brakes given the weather conditions anyway.

I wouldn't mention the second bit in bold, even if I've done it many a time myself.

Personally, I'd suggest to the guy that he sorts out his damage, you sort out yours, and you both move on as I reckon that this one would probably go 50/50 and it's not worth the loss of any NCB you may have.

So did he change lanes into you, or were you filtering.

If he changed lanes, it does matter for shit that you hit the back of him, he changed lanes into you without due care.

Arrow Your witness is THE most significant thing in this claim now. DO NOT lose him, and hope to fucking god that he's willing to testify in court.

Without a witness it is your word against his, and that tends to become a 50/50, which sucks arse.

My claim was practically the same thing, and i had a witness, and i was on target to to win. Was gonna go to court, and my witness decided that he couldn't be bothered (can't blame him, it is hassle) which meant that it went 50/50.

Massive arse suck.

Yeah I'm not gonna claim though don;t want the risk of losing no claims for the sake of a footpeg and possibly a small amount of compo. I have my witnesses name address and phone number incase the other guy decides to change his mind.

I'd suggest getting a copy of the witness statement on paper now if you can while its fresh in his mind and he doesn't lose interest.
It would be very helpful if your claim does occur and you need to challenge it, contact details might change over the course of a year and he may refuse to cooperate with the insurers at a later date.
