Just recieved notification from my insurers that after this little incident https://www.bikechatforums.com/viewtopic.php?t=210373&postdays=0&postorder=asc&start=0
the bus company involved is trying to claim from my insurance because "our vehicle was stationary, the motorcycle swerved, collided with another vehicle and came to rest against our bus" Evil or Very Mad Evil or Very Mad Evil or Very Mad Evil or Very Mad Evil or Very Mad Evil or Very Mad you dirty bus driving b*stard! So according to our friendly London bus driver I pulled a mad swerve to avoid 2 stationary vehicles and hit both of them!?? cheeky little w*nker! I suppose in a way they are right, he was stationary........... after he pulled out and closed off my exit. Well I just hope a little Karma comes his way

It did cross my mind once or twice that with the information that I have for him it wouldn't be too difficult to get his address, I already have his mobile number but I will resist the temptation to use it until at least after the claim has been dealt with, it's incredibly upsetting that I've managed to go 12 years without making an insurance claim and now even with a witness statement it could still go split decision,

Fight it all the way, they are just trying to bully you. Check for CCTV coverage. Do you have any witness statements?

Just because they have made a claim aginst you, it does not mean they will win.

hmmm.... I'm sure I said something about the bus company not just bending over..... but I was told that they would just settle to save the hassle.

If there was CCTV on the bus then you need to check that they still have a copy of it because they usually wipe it within a week or so.

Silly question... were you interviewed by the police about this? if not did you report it to the police straight away?

Driver procedure is something along the lines of:
accident happens
report it to depot
fill in shit loads of paperwork
report it to the police (if they didn't attend)
finish filling in paperwork
telephone some call centre to report the accident
finally finish filling in the paperwork
..... all of which has to be done in less than 6 hours

anyway afterwards we receive a letter asking to explain in detail about the accident
fill in paperwork
speak to managers (who decide what course of action to take against the driver)
driver gets from a caution (verbal warning) up to fired (sacked)

well I've requested the photo's that the driver took at the accident and cctv from the bus but nothing has come back yet, I have also registered a complaint with metroline and rather interestingly the phone operator made me aware at least 6 times that I was being recorded!! I guess this is so that if they find any details they can use against you they can. If I can get hold of the photo's i'd love to hear their explanation of how my bike got under the bus and pulled it out of the bus stop because obviously he didn't pull out! maybe I sneakily dragged the bus out while he wasn't looking.
Unfortunately now it looks like a question of waiting

Suppose you could always say you've been riding in london for the past (12???) years, without incident. Why would you pick that day to crash into a bus that, as they say, had not moved from the stop.

If you have a reliable witness and fancy your chances, then I'd suggest that you be absolutely adamant with your insurers that you were not at fault, and will not accept them paying out. Be polite but firm, and if they attempt to pay out, offer to see them in small claims court to recover the higher premiums you'll be paying for years.

If you're not happy with the way your insurers are handling it, find an independent firm who will pursue the bus driver to recover your losses.

Nwnf not an option as I am not claiming for injury, I have phoned many companies and they all say the same thing, my claim is not for enough money to involve a solicitor (less than £5000) as for the car driver as far as I know he hasn't answered any contact yet. I have one witness so all is not lost! It's just a shame that the 3 pizza delivery guys who were right next to the accident did a disappearing act as soon as the police arrived on the scene!

Metroline must be going through some financial trouble if they fighting a stupid claim like this, my firm would have paid out, then bent the driver over a barrel and buggered him senseless without the option of lube.

My thoughts are that the bus driver flat out lied to his boss out of fear of getting in trouble and is now in the position of having to lie to keep up the pretence untill proven otherwise, it's a bit of a c#nt really as since some thieving scrote stole my gsxr last night I most likely won't be riding till I get some insurance money which according to my insurers is usually about 3-4 months when dealing with metroline, seems like it might not be the first time they have dealt with them.

my last bike got stolen after the bus incident (why they wanted a smashed up 13 year old bike I can't tell you) but I found it last week abandoned with nothing missing. The gsxr I bought a couple of weeks ago to replace it Evil or Very Mad
