Well, it had to happen sooner or later. My first 'RTA'. Pulled up to a turning, indicated checked mirrors bla bla bla, initiated the turn, then BAM, the bloke who was WAITING at the junction, got tired of waiting and drove his stupid van right into my leg. After an obviously cool looking in air 180 spin (bike and me) and a little rolling around, i notice him trying to drive off!!!!

When i was sitting in someones car calming down he comes upto me trying to hug me and tell me how sorry he is and that he didnt see me, to be honest i was ready to lamp him one but just told him to fuck off, didnt see him again after that.

A witness stopped him and made him return to seen, plod and ambulance called. The police that attended the scene couldnt of been nicer and more pleasant if im honest, my hat goes off to them.

Havent had a chance to check how the bike is yet but apparently the handlebar is bent into the tank, rearsets (both) are bent/snapped, most plastics smashed and mirrors broken.

Only injury i sustained was to my right leg fortunately i had all my proper gear on. Bruising/swelling all over the foot, gash to ankle and bruising/swelling up the right side of my shin. Nurse said it looks like i had broken my tibia, fibia and at least 3 bones in my foot. Turns out, i havent broken anything, WIN!

Heres a selection of pics i have managed to talk aswell as a customary MS Paint diagram to make things a bit clearer.

https://i231.photobucket.com/albums/ee125/carlosamillios/accident.jpg

Holed ankle
https://i231.photobucket.com/albums/ee125/carlosamillios/IMG_0050-1.jpg

Final resting place (taken whilst i could still walk, 5 mins later there was no way i could walk on that leg).
https://i231.photobucket.com/albums/ee125/carlosamillios/IMG_0047.jpg

Mashed boot. The hole closest the sole had a 5 inch shard of indicator poking out, i was shitting it thinking it had gone into my foot, but it hadnt penetrated the inside luckily.
https://i231.photobucket.com/albums/ee125/carlosamillios/IMG_0051-2.jpg

Totally didnt see it coming, i saw the guy stop and stare straight at me, then i turned and he just put his foot down, couldnt believe it. Insurance is sorting it hopefully. Not a mark on my skid lid and only a couple of minor scratches on the leathers.

The police officer said they are going to charge him with Driving Without Due Care And Attention.

Lucky escape imo, everyone was saying how it would of been a lot worse had i not been kitted up. Now tell me im a twat wearing leathers/boots on a 125!

Ride safe guys.

Glad you're safe mate, keep that leg elevated and cool the swelling (15 mins at a time) with a bag of frozen peas wrapped in a tea-towel, the swelling's gonna be a bitch in a few days time.

The law's on your side with this one, hope you get all that's good for you. Thumbs Up

I had 2 people pull out on me last night. One of them which was a scooter.

Turned off on to a darker road, where's my lights. Feck main beams gone. Cue me riding home with full beam on.

Take him for all hes got...
Sore foot, painful to walk, cant go to work/school/college/see girlfriend.
Mashed gear, easily £500+ for gear.
Bike, obviously state you cant ride it anymore, you are scared of the damage it may have caused to the frame etc.
Pay out and refuse if its under the price you value your bike.

I paid 600 for 1 bike, paid out 1095, then 500 for another bike, paid out 1000 again.

Its what you value it at.

Enjoy the fairly free cash Laughing although...insurance may be a cow until its all settled

Glad you hopped away from that one.

Unless you're fully comp, your insurer won't do stuff-all for you. Try www.sorrymate.com or similar to make sure you don't lose a single penny.

And yes, I'm looking at day-glo helmets to go with my day-glo jacket. Micras, Range Rovers and Transits, the triumvirate of Fail.

They will sort everything out for you still. Mine employed a lawyer on my behalf.

They just dont fix the bike.

I've had 2 similar accidents (happen to me, not done by me!) when I've been in the car FFS - it's the one thought that scares me on the bike because there's really no way of riding (or driving) around that level of twatery.

But- all the gear, all the time... you never know when it'll pay off... good news nothing serious Smile

Twat Wink

Glad ur ok mate.

Things that you must claim for. These will ensure you get the maximum payout possible.

Damage to gear (All Gear!)

Dead bike, over-value it.
Say you had spent hours and hours in the garage/shed doing engine work restoring stuff etc. And dont be shy with the value either, state how many hours you think you spent and say you had replaced some expensive parts.

Loss of earnings << this is a given

Personal injury << play this one to the max (shame you didnt piss yourself cos thats a 2.5k payout straight away)

Loss of leisure time << Can be a biggie. Unable to go the pub, take bro/sis to the park, walk the dog, etc etc

Make sure you get a loaner bike and that the muppet pays for it.

Never accept the first offer, nor the second if you can wait. Push for full payout cos you are not at fault what so ever.

If Insurance companies give you shit about loosing your no-claims bonus tell them to check again as you never claimed on your policy as the other dude was 100% at fault.

BTW, prolly the best MSPaint " I nearly deaded" pic ever Very Happy

For real,
If you are involved in a RTC (not RTA anymore cos some-one is always at fault apparently) And its not your fault then shit or piss your self.

You can claim 2.5k for the embarrassment Very Happy

Leaving the scene of an accident can be an offence I think?
So if you have witness to that, maybe you should be telling plod about that?
Glad your still in one piece Thumbs Up
Nail his arse to the cross, he deseves it!
