I found out today that my insurers are not likely to ask for anything more than 80/20 in the cars favour, as his witness claims I was overtaking at 35-40 on wrong side of the road (when in fact I was filtering at 15-20mph on the right side).

However, I also understand that, several months after the accident, they have not bothered to contact my two witnesses, both of which (I imagine) could verify that I was not speeding, etc.

What to make of this?

Get a new solicitor, one who deals in bike claims. Its your right to choose who you use.
If not get your current one to contact the witnesses!

I used white Dalton, they were great with me and they are all bikers that work there. They specialise in bike accident claims. It took 4 years in my case to get the payout for my compensation but that i think was circumstantial.

I do not work for these people or have any affinity with them other then they handled my claim in 2004.

Yup, the solicitors working for your insurers will be the ones who can't hack it in private practice. Get independent representation.

Insurance companies always go for the path of least resistance.............

As said get yourself someone competant on the case and tell your insurance company that unless they contact your 2 independant witnesses then you will complain to the ombudsman because they are blatently ignoring information that could have a serious impact on the outcome of the case.

Just because you were filtering on the wrong side of the road doesn't mean shi*. Filtering is perfectly legal and car drivers still have a responsibility to drive with due care and attention and suprisingly for them means looking round for hazards etc that may effect them.

You can always call on the help of the insurance ombudsman if you believe you're not being represented properly.

Interesting, as unless there is a solid white line you are entitled to use both sides of the road.


Get a rocket up their arse or a new solicitor.
