Until you ACCEPT an insurance settlement, its still YOUR bike to do with as you see fit.... though anything you do to a bike that is in 'despute' can effect settlement.
Personally I'd suggest that the value of a '95 CBR6 isn't as high as you suggest £1300 is a highish dealer price. Insurance Co's will go by Parkers guide and 'average' sale prices, and on that basis £800 probably isn't unreasonable. Rare colour scheme doesn't REALLY make it more valuable, just harder to find matching panels for!
If they have valued it at £800, and suggested £187 'Salvage' value, then, what that means is they pay you £600 and its up to you what you do with the bike.
If they declare it Cat-C ecconomic write off, and report it to DVLA, you need to get a fresh MOT on it to clear the cat flag, as technically the bikes not MOT'd, depsite fact you may have a ticket on it. Cat-C declaration deems it damaged, and demands new MOT, so DO NOT ride it until tested after accepting a cheque.
Personally, I would have thought you could get teh panels fixed, or get 2nd hand panels of e-bay or a breakers for a couple of hundred, so a £600 pay-out should give you scope to sort it however you preffer. Or £800 could get you another CBR of similar age, and possibly condition.... or you could hang out for a better settlement, BUT I doubt you'll push them up by more than a couple of hundred at best, but in the meanwhile you have a buggered bike.... ____________________ My Webby'Tef's-tQ, loads of stuff about my bikes, my Land-Rovers, and the stuff I do with them!

You sure about that?
Noone mentioned anything of the sort when my car was bumped and Cat C'd. Has had MOTs since but at the time I kept the old one running . Taxed it in between the bump and the new mot too. |
It's open to interpretation, but if an insurance co notify DVLA of Cat-C it needs MOT to clear the flag, or have log-book re-issued.
If you run about on the 'old' MOT, then grey area. Technically you still have a current MOT, but MOT cert isn't proof of road-worthyness or safety, you are still obliged to ensure the vehicle you are using on the road if roadworthy, irrespective of MOT valididty.
If you had another bump, and the bike hadn't been re MOT'd... it would be something of a grey area if it popped up as still having the Cat-C flag in force..... was the vehicle road-worthy before accident? How much damage was the result of accident or residual from previouse that resulted in Cat-C etc.
If you police followed you, and ran your number through the NRC, DVLA record would chuck up uncleared Cat-C... they are going to go over the bike with a fine tooth comb, aren't they, if they dont take the interpretation that Cat=C means do not use until cleared...
So... it MAY be a grey area, as everything around the MOT rules, BUT, practically, such an obviouse one to get you into trouble.... for the sake of £30 after a pay-out? ____________________ My Webby'Tef's-tQ, loads of stuff about my bikes, my Land-Rovers, and the stuff I do with them!

Cheers, in this case it was a car, damage was cosmetic damage to a door (VERY low value car hence written off). There honestly was no suggestion from anybody, insurance company or otherwise that it needed to be rechecked. This was a few years ago now so is no longer an issue but I would have been pretty peev'd if I had been pulled for it.
Thinking about it, when I first got the car it had just been written off as cat C (double cat C cars FTW) and had not yet had a new MOT. I was pulled over for a drink driving test after a few months (still prior to the first MOT since the bump) and they didn't mention an outstanding cat c flag. Must've been lucky . |
