I was going to tax my bike yesterday at the post office but couldnt find the mot cert anywhere. If I tax my bike online will I be ok riding it displaying the old tax disc until the new one arrives or will the fuzz take an unhealthy interest? Wanted to get out on it today.

You won't get caught by ANPR as you'll come up as taxed I think, but they could do you for 'failiure to display' which carries a fine I think.

What is the fine for 'failure to display'? I Must admit that I have a pile of tax discs that Ive bought and never got round to putting on the bike. Its always been talked about as if you would have to be very unlucky to be done for it, maybe if you had been pulled and they couldnt make it stick then they might go for it as a last resort?

Mines in the post at the moment and it wouldnt stop me from taking the bike out for a second. I think its ridiculous that in the modern digital age we have to stick a coloured piece of paper to the bike to make it raod legal!

Failure to display tax is an old offence where they couldnt check you with anpr or by phoning, I havent heard of anyone getting done with it alone, its normally an "add on" to a whole string of offences.
Been reported for not displaying before, nothing come of it.

If you do it online it may be worth getting a printout of the confirmation at the end just to carry with you. I don't think it's a legal document but at least it's SOME form of proof that you HAVE taxed it. (Better than nothing)

You're fine, there's now an explicit 5 day grace period to display the disc if you've taxed online. So if you're stopped by a copper, punch him in the helmet and tell him some guy online told you so. Thumbs Up

STILL get a printout... If a copper wants to play funny buggers and try to do you for "failure to display" you've got the confirmation, take it to court and the case will be thrown out.

Here you go, section 33 of the vehicle excise and registration act 1994. The only legislation that covers failure to display.

So it's fuck all to do with the road traffic act, just for info. If a copper tries to quote bullshit at you.

[F2(1A)A person is guilty of an offence if—
(a)he uses, or keeps, on a public road an exempt vehicle,
(b)that vehicle is one in respect of which regulations under this Act require a nil licence to be in force, and
(c)there is not fixed to and exhibited on the vehicle in the manner prescribed by regulations made by the Secretary of State a nil licence for that vehicle which is for the time being in force.]
(2)A person guilty of an offence under subsection (1) [F3or (1A)] is liable on summary conviction to a fine not exceeding level 1 on the standard scale.
[F4(3)Subsections (1) and (1A)—
(a)have effect subject to the provisions of regulations made by the Secretary of State, and
(b)are without prejudice to sections 29 [F5, 31A] and 43A.]
[F6(4)The Secretary of State may make regulations prohibiting a person from exhibiting on a vehicle [F7which is kept or used on a public road] anything—
(a)which is intended to be, or
(b)which could reasonably be,
mistaken for a licence which is for, or in respect of, the vehicle and which is for the time being in force.]
[F8(5)The reference to a licence in subsection (4) includes a reference to a nil licence.]]


Important bit is this

Quote:
A person guilty of an offence under subsection (1) [F3or (1A)] is liable on summary conviction to a fine not exceeding level 1 on the standard scale.


Summary conviction means it has to go to court, they can't do you at the side of the road, and level 1 is a maximum £200 fine if I recall correctly. Can't remember the fine levels off hand, but it is in the manner of £200 at level 1.

Translates as they will never bother, as it isnt financially worth it.

If you have paid for VED then don't worry about it, in fact I don't display at all anymore on the bike. In my opinion, if we are going to have a computerised system then lets fucking well have one, and stop messing about with all these pointless bits of paper.
