Basically i took out a personal loan for a bike back in 2008 for £2500 over 36 months at 86.11 per month taken on the 1st at 18.4% APR. Now back in 2009 I had to stop working due to illness and obviously i missed about 3 months payments. Now when i commenced payments again I requested to change the payment date to the 16th of each month and they said yes thats fine.

Now the loan should have come to the end of the agreement this month. Now i know there would be some arrears due to these missed payments and the £30 charges that go with these plus the interest. And it works out taking into to account the missed payments etc i owe them £400 and odd pound in payments and charges.

Now i just received my June 2010 to June 2011 statement and its saying my total balance is now £944. Now looking through the statement, for every payment on the 16th of £86 the following day I'm being charged £15 for late payment plus interest.

Now because these statements are only 6 monthly i have only just picked up on this. As my last statement didn't show these and the balance looked right.

So is it me who's fucked up or is Blackhorse for not updating their system and the agreement for the payment date change.

Advice appreciated.

You fucked up for not paying... they rape you silly if you miss a payment.

I borrowed the same, I had about 4 months out of work... its taken me another 6 months to get it back where I was before losing my job Laughing

From the looks the computer didnt update so its Black Horses mistake.

Proving that is going to be the downfall though because all you have is a blokes say so on the phone line and nothing in writing so the chances are you'll be the one out of pocket and have to pay it.

You need to sort this out sharpish. On your credit report, you'll currently be showing a "late" payment since you thought it had changed to the 16th. In order to rectify your credit rating, you must get written confirmation payment is due on the 16th, not the 1st.

When you changed to the 16th, they should have sent some documentation highlighting the changes. Your right,the bank think its ok to move payment dates around, but without docs to support it, you'll not get your £15 refunded for every month they've charged you.

Finally, with a black horse loan, I'd be very surprised if they didnt chuck in a free 3 month payment holiday anyway. Doubt you could have it applied retrospectively, but worth a shot anyway.

I'd double check the small print on your balance as well. Its usually not what you've got left to pay in total, it's usually the amount of capital left to pay before interest. Thats why this figure stays roughly the same for the first half fo the loan period, as you pay the interest charged first, then the capital afterwards,

when you notified of your wish to change payment dates, did you do it over the phone? Did you get any sort of reference number, confirmation letter, or confirmation e-mail?

I've found black horse to be one of the better lenders. Write them a letter telling them you arranged a change of payment date and want the penalties removed.

I thought these type of company recorded calls, it might be worth requesting a copy of the call as proof that your requested the payment date changing that they agreed to do it

I've found that usually when changing the payment date they want the next month's payment early, not let you make the payment later. I had this when I wanted to move a payment date from the 28th to the 1st - they took a payment on the 28 AND the 1st.

That makes sense in that case though because the 28th and the 1st were not in the same month.

Principle is the same, if you normally pay on the 5th and want it moved to the 16th, they'd just be moving the NEXT month's payment due on the 5th to THIS month's 16th.

Hmmm, maybe. I'm not sure. That would seem harsh, I agree, but your example above does not so much.
