PostPosted: 12:51 - 14 Sep 2011    Post subject: So my friends dad reversed into my bike... Reply with quote

I was going out with my mate so I drove my bike to his and parked up where I usually park, I leave my helmet and gear at his and go out, 20 minutes later he gets a phone call from his dad telling him to come home he's knocked my bike over Shocked Shocked Shocked

When we get back he's managed to lift my bike up onto the side stand, apperntly he walked right out his house and got straight into his car, checked his rear view mirror, but the bike lies out of sight (too low), and he went to reversed out as he usually does and hit the bike, from the side stand side. The bike has just gone right over, the side stand put a hole in his bumper as it toppled.

Damage to bike, Front nose cone smashed up, need both front indicators, slightly bent side stand, front brake lever, slightly bent back brake lever, scuffed crash bungs.

He was very appologigetic and took full blame, he said he'd pay for new indicators, front lever and nose cone, and I'd fit them myself.

He said this 30 days ago.... I keep asking my friend to ask his dad when he'd going to get the parts/give me money and he just keeps saying he hasn't got it atm, and this has gone on for 30 days.... It is too late to claim via his insurance now?

Because quite honestly he's took the piss now...

Its not too late to claim through your insurance. Phone your mates dad, tell him you'll be claiming for the damage through insurance and see what he has to say. Also remember to tell your insurer that he reversed into you, not reserved!

Got witnesses? Pictures from the scene? Do you have an admission on record?

Remember, your claim is against him, not against his insurer. They have an obligation to cover his liability, but only if they accept or a court decides that he is liable.

If you contact them (who are they? Is he insured? if you can't find out, you may need to go via the MIB), they'll quite rightly say "Hang on, spotty oik, we need to talk to our client to confirm that your story isn't a complete fabrication."

Then it's your word against his. How confident are you about which side his son is going to take?

I definitely think that you should pursue him, just be sure to document everything beforehand. The paint diagram is a good start, now get some pictures of your bike and the damage to his car if it's still there, get witnesses if at all possible, and don't change your story one iota once you start down the route of a hostile claim.

Or just smash the hell out of car or his wife/daughter's gary, it'll be much more immediate and satisfying.

Stop asking your friend and ask his dad straight, just say look, you've had enough time.. My bike is a state and I want it rectified as soon as possible.

Man up and treat it like an adult, go to the person who did it.

If my friends dad did it to mine, yes i'd have to think about how it may affect my friend, but tbh its my bike, If you was to reverse into his car and kept fobbing him off, what would he do?!
