Wife has a 07 Vectra diesel she's owned for a couple of years, over the last year it's been occasionally temperamental, sometimes juddering like a fueling issue, occasionally it has cut out completely and left us stranded for 10 minutes whilst it then started back up and carried on, almost like a heat->cooldown issue.

Wifes had enough and wants to trade it in. It's been into Vauxhall a couple of times previously and they found no fault... I don't have much faith in them however she won't listen.

Where do we stand in taking to a sales garage and trading it in for another car in it's current state as long as we make them aware of issues we have previously had...? Last thing she wants is financial comeback if it finally gives up the ghost completely on them.

Otherwise it drives fine!! Fuck Vauxhall cars Thumbs Down
Trying to talk her into getting Jap or very least a solid german make.

When you part-exchange, they buy it as they see it so it's up to you what you tell them.

Caveat emptor may not apply in this case as the seller knows of several defects and is is willingly with-holding the information prior to the sale.

Not really as per OP I wanted to know if we advised of it's current state - then 2 weeks later it dies completely on the garage where would we stand.

Yes, what I am saying is if you willingly withheld the information, there are repercussions. If you advised them of any known faults, there are no comebacks.

And even if you didn't tell them, it would still be up to them to prove that you knew about said faults. But as you say, if you tell them, you have done your duty.

Is this a serious question? You're selling it as-seen, as roadworthy, but with no other express or implied warranty. It's their responsibility to ask questions about it, or to examine it. They're the (ostensible) professionals, not you, and they should expect that there's a reason why you're wanting rid of it. Don't volunteer any information, but don't tell any (obvious) lie about it either.

Sure, they might later discover it's a lemon, but how are they going to get any money out of you? Take you to court? Even if they had grounds - and they don't, you could just refer them to the Vauxhall dealer who didn't find any fault - it's literally not worth their time. Ignore any contact from them.

If you're still in a moral quandary, just put it through an auction. It's more of a gamble, but then it's clearly understood as being sold and bought as-seen, and you don't have to say a word to anyone about its condition.

That's incorrect. If they asked and you didn't tell, you're in trouble. If they never ask, it's their problem.

Been there, done that!
Traded in a 5 year old Astra, with sod all in the way of compression in 2 cylinders. Laughing
The sales bod didn't even start it up, popped his head through a open window, looked around and gave it the thumbs up. Mr. Green

Dont sweat it!

FFS, just sell it, upto them to determine condition, ignorance is bliss, the only thing your gonna get from telling them, is a lower offer to shaft you for a few hundred quid.

I sold my last car to a DEALER with a burst front brake flexi hose. Didnt tell him anything. Im not a mechanic, i dont know what this puddle is?
He put it straight on sale with a huge mark up. When i popped up after hours he hadnt replaced the pipe, probs did know anything about it.

lol, they'd be only too happy to sell you a car with a fault like that, just sell it to them. As said above, if they don't ask "has it any faults", don't say anything. If they do, tell them it recently had vauxhall give it a service and they found no faults.

I doubt you'd get any comebacks anyway, they'll probably just trade it to another dealer.

My mum used to have a Fiat Panda that developed a fault where it overheated badly if you drove it for more than about 20 mins. She drove it to the dealers, waited an hour or so before going in (so it cooled down), then when they test drove it, no problems. Traded it for a new car (another Fiat, sigh, she never learned Rolling Eyes )

Yes, but not to hand. I looked it up a couple of years back after having all kinds of bollocks threats made after a cam-belt snapped on a car I'd just sold.

Just let them take the car. They have already checked it, and not found a problem - i.e. done sod all and charged you a fortune.

Get rid of it and buy a decent brand.

I don't suppose you have a legal source for your opinion. Note that a "legal source" is a statute or case law precedent, not what your mate Baz swore happened to him that one time.

I am a law student, therefore, I am well aware of what a legal source is. As a result, my 'opinion' is the law.
