I am in the process of selling my GPZ, I bought it as a project and it's now at a good enough standard to go back on the road, it still has MOT untill Feb, but has no tax and hasn't been ridden properly on the road since it's last MOT.

The problem I'm having is that most people who I've spoken to on the phone have said they will ride it away, where would this leave me if they got caught riding it untaxed?

You sold it with no tax, they are the new owners after handing over cash.

Up to them to sort it out.

DVLA is slower than a snail to do anything! and for them up until they receive and process the logbook with new owner details... well you know where this go...

OP make sure that you issue the potential buyer a receipt of some sort... bike sold without blah blah and aske other party to sign it, date it and time it while you are at it! just in case!

Bought a few vehicles without tax
options are plentyful and shouldn't put any sensible buyer off

at least a couple of times I have handed over the money for tax and taken previous owner to the nearest post office with their valid docs, got tax disk and then filled in V5 docs to be sent off

Of course this wont be able to happen on a Sunday or out of normal business hours

Options are then either doing it online (and trusting the seller will post it on when it arrives rather than cashing it back in!)

On the occasions when it has been impossible to get a tax disk due to a lapse in MOT or insurance by the seller I've just hired a van to collect (or on one occasion got a courrier to pick the bike up on my behalf as it worked out a lot cheaper than hiring a van and paying for fuel both ways)

as a seller I would not be that bothered about them riding away if things were not up to date on the vehicle , just make up a receipt with date and time and a simple disclaimer and get them to sign it (maybe get them to bring some form of ID with an address on it and scan it...its what we do at work when people come to collect cars / bikes)
At least you have proof that you have done everything possible to cover your own back if they decide to knobble fuel/run down kittens on their way home

Its not down to you, its down to them to be legal on the bike. If you let them test ride the bike with no tax... it might be a different story but you need to make them aware the bike has no tax if they want to ride it away after the sale.

The law is much clearer with regards to insurance. If you lend a bike to someone then it is your responsibility to take steps to ensure they have adequate insurance cover. I believe that saying to them "Do you have insurance to ride the bike?" and them replying "Yes" is the end of your liability. If it turns out they don't have insurance then supposedly you're in the clear... but obviously there is no proof of a verbal exchange taking place.

Uhuh, but also V5 doesn't prove ownership.

He can literally say there is no tax, its your arse not mine.. and thats it.

The V5 is no proof of ownership and we all know that, but until it gets changed....

Best option is a receipt... stating the obvious!

Well they either stole it or bought it... as long as they pay him, its his end done. They wont go back to him, they'll go to the guy on the bike... Rolling Eyes They always say "oh I just bought it"

since the bike is still in your name until the dvla change the details
