Quick question, bit of a silly one but im a bit irrate.
Partner lives in a dead end road, the house is owned by her friend, who lives in another house, same road but up a bit futher.
Ive never seen eye to eye with him and he would love me to break up with my partner.
However we had a row last night, about 11pm.
She was drunk, I went out to get the bike and go home but we argued more.
He wasnt in at the time but I beleive my partner had told him what had happen.
He seems to beleive I was drunk (as she was drinking) But I had one bottle of beer.
He has now told me im 'Banned' from the road, The police will be notified. He dosnt own the road, but can I actually be banned lol?
Would the police listen to him (he is arrogant, a right knob who thinks he knows it all) He wasnt even in.
Also he had text me aswell just now, that if I go near her house the police will arrest me & are now aware.
Blood is boiling im sure that cant be true as they have no evidance of anything.

He's not a cop. Therefore he has no power and I doubt the CPS will actually use his word against yours as evidence to get you banned.

Unless he is a cop whereby the word of the cop (backed with evidence to make it a stronger case) its possible.

never heard of being banned from a road before Confused he's talking shite, if there was such a thing the police would have been the ones to let you know not him.
If he has phoned the police expect them to try and catch you out drink driving, chances are they wont care.

If you was not stopped by the police and breathalysed then nothing will happen from it, go ride up and down the road tooting your horn.

It seems some neibours complained (So I am told) how true that is I dont know. But he isnt a cop. As long as i know I cant be banned by him then its fine. Ive done nothing wrong apart from a slight domestic in a street made of cheese.

I think the stock BCF response of 'Punch his tits, do him up the Gary' will suffice.

I could ban you from my little bit of road, as it's privately owned by me. Unless he has a similar luxury* he can't do sh*t. In fact, you probably have a stronger case for harrassment against him than he could ever have against you.

*For 'luxury' read curse. It's our responsibility to keep the road clear and in good condition. Fortunately it's only about 30 yards long.

Hi

If it is a private road that he owns then he might have some power, but given that it would seem to have public access then not really much chance of that.

All the best

because you are a lesbian people are against you from the off, also because you you are a lesbian you are confrontational as a defence thing. That puts peoples backs up even more. And you ride a bike.

the guy can't ban you from anywhere unless he goes to court and get you banned from his home and the one he rents out, but he hasn't so he fails there.

As for drink driving, the only people who can do anything are the police and they haven't done diddly squat, so you are ok there.

As for your partner, she can tell you not to come around, but I doubt a lovers tiff will end up like that.

What I would do if I was you, (besides play with myself in front of a mirror all day) would be to keep my head down for a bit, make up with the other carpet muncher, don't read or answer any texts from the guy. ignore the neighbours.

Simple solution... What's the address? BCF rideout anyone?

A couple of dozen bikers parked up, standing around in a lawful manner (read, cannot be moved on by the police) will really boil his spuds.

I seem to think your a londoner louise... I'm in norwich but would happily travel a couple of hours to partake in a stance against nobbery such as this. It would have to be a saturday though!

Measured response:

AAAAAAAAAAaaaaaahahahahaha, moron said WHAT?

If you have or obtain any other evidence of him being such a cock - "a course of conduct" - feel free to dob him for harassment:

Prevention of Harassment Act 1997 wrote:

1 Prohibition of harassment.

(1)A person must not pursue a course of conduct—

(a)which amounts to harassment of another, and

(b)which he knows or ought to know amounts to harassment of the other.

(2)For the purposes of this section, the person whose course of conduct is in question ought to know that it amounts to harassment of another if a reasonable person in possession of the same information would think the course of conduct amounted to harassment of the other.

2 Offence of harassment.

(1)A person who pursues a course of conduct in breach of section 1 is guilty of an offence.

(2)A person guilty of an offence under this section is liable on summary conviction to imprisonment for a term not exceeding six months, or a fine not exceeding level 5 on the standard scale, or both.

That's towards the upper limit of Magistrates' powers, it's about as serious as a summary offence gets.

Oh, and if he's ever referred to your gender or sexual preferences, then it's Equality Act 2010 harassment, which is a hot button topic - there'll be a special unit just gagging to take it on.

If you think it's likely to escalate, get your retaliation in first.

Or you could just laugh it off and tell him to stop being such a prick.

I wish it were that easy to ban people from my road Very Happy

He can do the precise sum of fuck all to prevent you entering the road, doing handstands on the pavement outside his window or even walking round with a banner saying 'you cant ban me, I'm a free woman'.

If he wants to complain about you to the police, let him. In essence, there is fuck all they can do about either without empirical proof you are causing him a nuisance...

I'll be up for the BCF mass legal park (MAG are such amateurs with their protests Wink )

Thanks for the replys people. Some funny comments which lightened the mood.
Ive just got in from work, Ive been texting the mrs most of the day.
Shes pretty torn by it all.
As its 'his' house I have respected what he said - that was to stay away, how ever she feels stuck as I cant go around.
As for the road, it is public - Not alot of people 'like' him in the area as he is an utter knob.
Aprently he has been tryin to get her to go to the Police with him, altho she had told him no.
He dosnt have anything to go by now.
Even if he tryed to get me done for drink driving im sure, I can be questioned but again no evidance -
She has asked me to reply to him, but im not giving him 1)amnuition & 2) the satisfaction.
The neibours did complain and its the same ones before who have complained about noise. (the house's are made of cheese there)
He keeps giving her shyte about last night and shes had enough, but wont stand up to him. Its her life and he seems to try and get too involved.
Again, thanks for the replys.

If your partner is serious about you, she should man up and tell him to mind his own business and defend you, not bow down to his demands.

He has no right to dictate who she lets in the house - she pays rent (i'm guessing) so she's got rights.

If it's a small road, why don't you knock on each door of each house and apologise for the disturbance you helped cause the previous night. If you don't want to do it to your girlfriends landlord, then stick a note in saying the same. And promise next time you have a barny you will make it less public. Karma

Thanks Clanger...
She has said sorry to the neibours before when loud noise has happened - This is how bad the road is, even the Landlord was outside in her garden and the noise was a respectfull level - yet complaints were still made.
Im not fussed about the people next door - they make noise.
Its the idiot of a L/L that wants us to break up because he dosnt like me. Its gotten to another level.

He has no power to stop you using a public right-of-way, and no right to ban you from rented-out property either unless he can get a court order for which there would have to be a very good reason. If he's rented out the property he cannot dictate who comes and goes.

On the other hand sending you intimidating messages by phone is illegal and you should think about making a formal complaint to the law. Only problem is that he will become landlord-from-hell for your missus.

I would make a point of going round there as often as possible and have a mini-dv cam in my pocket running all the time to record his inevitable tirade. with any luck he will come right out with ' I thought I told you that you're banned from this road' and that will get him arrested. Stay all sweetness and light and it will incense him into saying something nasty then straight to the police station and put in a complaint about his intimidating behaviour. He'll likely cop a nice £80 fine. Might even be able to get him ASBO'd.

You're woman, he's a man. Makes it very easy for you and not very easy at all for him to counter with anything similar.

Thanks Pete.
Ive relayed most of that back to the mrs as the Landlord is getting rather nasty to her, in regards to me showing my face down that road.
Thats pretty much put him in a dodgy spot.
Im very much gratfull. I shall keep this updated if anything else happends.

If your muff is renting the house he can't dictate who she can invite in. Tell him to go feck himself.
